    Police: Woman fatally shoots Benning soldier breaking into her apartment

    The Fort Benning soldier killed in a Sunday morning shooting on Armour Avenue had broken into an apartment and was shot by the resident living there, according to a police report on the incident.

    Christopher Warden, 31, a Fort Benning soldier apparently thought the apartment was where his wife had gone to pick up her daughter. An unidentified friend of Warden’s and a neighbor in the apartments tried to tell Warden he was at the wrong address. But Warden beat and kicked the door, then broke out a window and climbed through.

    Once he was inside the apartment, the resident there heard him, armed herself and yelled at Warden to leave. He refused and walked into her bedroom where she fired a handgun once into his chest.


    The shooting happened at about 7 a.m. and Warden was pronounced dead at about 8:30 at Midtown Medical Center.

    Columbus man kills home intruder in self-defense, police say

    A homeowner shot and killed an intruder in self-defense late Monday on Kingsberry Street, according to Columbus police.

    Derrick Cureton, 23, was pronounced dead at 10:30 p.m. His body will be transported to the Georgia Bureau of Investigation crime lab for an autopsy, said Muscogee County Chief Deputy Coroner Freeman Worley.

    Columbus police were called to the 5300 block of Kingsberry Street around 9:50 p.m. Monday to investigate a shooting. They found Cureton dead on the scene.


    Police asked that anyone with information on the shooting call Sgt. Michael Dahnke at 706-225-4296.

    “The initial investigation indicates that the homeowner was confronted by an intruder and defended himself,” Lt. Greg Touchberry wrote in a news release.

    Because of what’s called the “castle doctrine” authorizing residents to use deadly force to protect their homes, Georgians are free from prosecution under the law if they “reasonably” believe such force is required to stop the “unlawful entry into or attack upon a habitation.”

    The law has three stipulations:

    The intrusion must be “violent and tumultuous” so the resident believes its purpose is “assaulting or offering personal violence” to someone inside.

    The intruder can’t be “a member of the family or household,” meaning a resident can shoot strangers who break in, but not someone who lives there.

    The resident must believe the intruder broke in to commit a felony, and deadly force is necessary to stop it.

    This “castle doctrine” also extends to temporary habitation you may occupy only overnight.

    MARION COUNTY, Tenn. (WDEF) — Marion County deputies and the TBI are wrapping up an investigation into a fatal shooting Monday night.

    TBI offices are closed, but witnesses say one person was killed.

    No names will be released until later on Tuesday, but the shooter apparently has been released from custody.

    The case is now being handled as self-defense.

    Woman fatally shoots man who broke into her home, police say

    A woman shot and killed a would-be burglar early New Year's Day after the man allegedly broke into her apartment while she was sleeping, Houston police said.

    The woman awoke in her bedroom at the Mirabella Apartment to the sound of broken glass, according to the Houston Police Department. She looked up, and a man was standing in her bedroom, she told police.

    He came toward her bed, and that's when police say she grabbed the pistol she kept near her and fatally shot him.
    She had told the police she had seen the man walking around the apartment complex before.

    The woman has not been charged in the unidentified man's death, and police say they will refer the case to a Harris County grand jury.

    No charges filed after man shoots brother multiple times during argument in NE Houston, police say

    HOUSTON — A man was shot and killed by his younger brother after an argument turned violent in the Northshore area, the Houston Police Department confirmed.

    Phillip R. Mejias, 36, was dead in the 731 block of Fawn Drive around 5 a.m. on New Year’s Day.

    Investigators said Mejias and his younger brother, 25, got into an argument that turned physical. Following the confrontation, the victim followed his sibling home and tried to get into the brother’s residence.

    The brother shot Mejias multiple times as he was breaking into the back door of the home, police said.

    According to the police department, the brother was questioned by investigators and then released without charges.

    An investigation is still ongoing.

    State is not going to prosecute Spenard enterprise proprietor who shot buyer

    The Anchorage District Attorney‘s Office has decided not to prosecute the owner of a Spenard business who shot one of his customers last month.

    The owner of Determine Design, Daniel Clift, said he acted in self-defense when he fired his handgun Nov. 15, shooting Shelton Landon once in the torso.

    While the shooting case “meets the elements” of first-degree assault, prosecutors would not be able to prove in court that Clift didn‘t act in self-defense, according to from Deputy District Attorney Christina Sherman to Anchorage Police Detective James Anderson.

    “This in no (way) implies that Mr. Clift‘s conduct is not of concern, but simply that the state will be unable to disprove self-defense beyond a reasonable doubt,” the letter said.

    Officials have not released many details about what exactly happened inside Clift‘s architecture company, Determine Design, that November afternoon.

    The letter, dated Thursday, does not specify why the state could not disprove self-defense. To reach the decision, it said Sherman reviewed police reports, photos, audio, a 911 call, medical records and copies of emails. Sherman declined to comment further.

    “The letter speaks for itself, and we do not discuss criminal investigations aside from what is in the public document,” she said in an email.

    Anchorage police said in a that a customer went into Determine Design on Nov. 15 to talk about a project.

    “An argument ensued over payment; the employee produced a gun and shot the victim once in the torso,” the police statement said.

    The employee immediately called 911 and reported that he had shot someone, according to police.

    Renee Oistad, a police spokeswoman, referred any additional questions about the shooting to the DA‘s office, which said it could not provide any more information.

    In phone interviews this week, Clift and Landon told contrasting stories about what exactly happened inside of the second-floor architecture company last month.

    The business is located on West Northern Lights Boulevard, just west of Arctic Boulevard.

    Clift said in an interview Thursday that Landon was disgruntled and violent when he came into business the afternoon of Nov. 15.

    He said Landon had asked the company for a change order on architecture plans for a marijuana business he is starting in Spenard. The architecture company billed him $600 for the work and he didn‘t want to pay, according to Clift.

    “He was disgruntled and basically said, ‘Why should I pay you?‘ and grabbed me and pushed me back across the office,” Clift said.

    “He started whacking my shoulder and saying, ‘Now you‘re pushing me. Now you‘re pushing me.‘ “

    Clift said he repeatedly asked Landon to leave. Clift said he grabbed the handgun he kept in the office, and said he hoped to try to keep Landon away while he called police.

    “He walked back toward me and tried to get in my face and I think he was trying to take my gun,” he said.

    Clift said he pulled the trigger.

    “He was physically aggressive and I didn‘t know what else to do,” he said.

    He said he did not believe Landon carried a gun that day in the shop. He said he wished he could have gone back in time and not started the project with Landon, so “we could have just avoided this whole situation.”

    Landon said in an interview Friday that he never pushed or shoved Clift. He never got violent at all, he said.

    He said he came into the business that day with $600 in his pocket, intending to pay the bill so he could get the drawings.

    He said he asked Clift for an itemized receipt so he could better understand the added costs. He said Clift responded, “Just pay the bill, Shelton.”

    Landon said he became agitated, stood up and asked Clift, “Have I ever screwed you guys or stiffed you guys or given you any reason to be tripping over 600 bucks?”

    He said he then thought Clift was walking over to a computer to look at the invoice, but instead produced a handgun.

    “I throw my hands up in the air and say, ‘What are you going to do? Shoot me?‘ And that‘s when he shot me,” he said.

    “I had no weapons, no guns, no knives, no nothing and he shot me.”

    Landon was taken to the hospital that day. He said he underwent three surgeries. One of his kidneys and part of his stomach were removed. He said he was in a coma for about a week.

    “My equilibrium is way off. I‘m trying to learn to walk again,” he said Friday.

    says a person can use deadly force if he or she reasonably believes its use is necessary for self-defense against death, serious physical injury, kidnapping, sexual assault, sexual abuse of a minor or robbery.

    State law has always said people attacked in their home do not have the “duty to retreat” — a legal obligation to flee if they can do so safely, said Senior Anchorage Assistant District Attorney James Fayette.

    In 2006, the Alaska Legislature eliminated the duty to retreat for people defending their business.

    Then in 2013, the Legislature did away with the duty to retreat “if you‘re in a place where you lawfully have a right to be,” Fayette said.

    Visalia man shoots car burglar in his driveway, police say

    VISALIA, Calif. (KFSN) -- Police say 37-year-old Nicholas Wilkerson was in the process of burglarizing a car parked in a driveway when he was confronted by the homeowner who was armed with a gun.

    The confrontation escalated and the homeowner fired his gun, striking Wilkerson, according to police.

    Wilkerson was taken to Kaweah Delta Medical Center for treatment of non-life threatening injuries.

    Store owner shoots alleged 15-year-old robber after 17-year-old suspect pulls out gun

    The brother of a store owner who shot an alleged robber said his brother almost started crying when he heard one of the suspects was 15-years-old.

    The incident took place on New Year's Eve at the Three O's convenience store located on 25th street in Fort Pierce.

    The store owner, Sami Said, said the incident was captured on surveillance video.

    It shows to teens waking in the store.

    Said said the video shows one of the suspects pointing a gun at him and then both stuffing money into a bag before running out the front door.

    "All I see is a gun in my face. I backed up and give them the money," said Said.

    He said seconds later one of the suspect's went back to the counter and that's when the store owner fired.

    "The guys leave but one is coming in when he come I say you wanna come in for other cashiers and I shot him inside the store," said Said.

    Store employee Willie Plain was outside when he heard the shot.

    "And when I looked up my boss man was shooting at him and he came out shooting," said Plain.

    A few blocks away, Briana Fernandez was at home waiting to celebrate the New Year when she heard screaming.

    "Down the street I seen a guy run and we heard him say I've been shot save me," said Fernandez.

    She says the next thing she heard was someone pounding on the neighbors door asking for help.

    "And then I hear somebody save me and I was like what's wrong he said I've been shot," said Fernandez.

    Police responded shortly afterwards.

    Investigators saaid the suspect who was shot was a 15-year-old boy from Fort Pierce.

    The store owner's brother William Said said his brother was upset when he heard one of the suspects was just 15-years-old.

    "When he found out they are young, that's weight hit him and he almost started crying for it because he said nobody deserves to die for that money," said Said.

    Police said a second suspect, a 17-year-old boy also from Fort Pierce, was also captured and taken into custody.

    Both face armed robbery charges.

    The 17-year-old also faces a weapons possession charge.

    Fernandez said when she called for help for the 15-year-old she didn't know anything about a robbery.

    She's just glad no one was killed.

    No charges filed shooting that left one dead in Marion County, Tenn.
    No charges have been filed in the fatal shooting Monday night of a man on Dancing Fern Road in Marion County, Tenn.

    In what authorities say appears to be a shooting in self-defense, 24-year-old Brandon Shrum was killed by the homeowner at the property, Marion County Sheriff Ronnie "Bo" Burnett said Tuesday. The homeowner was identified as Johnny Watts of 1040 Dancing Fern Road.

    Dancing Fern Road is a dead-end, mostly one-lane road that leads off of Valley View Highway north of the tiny town of Sequatchie on the west side of the valley. A few homes are scattered along the road as it ascends the slope of the Cumberland Plateau.

    Burnett said Shrum was living at a residence just a few houses away on Dancing Fern Road. The sheriff said there had been some "bad blood" between the two men.

    Burnett said Shrum had gone to Watts' home around 10 p.m. Monday and was beating on the walls of his home with a shovel and making threats.

    "At some point they have a confrontation and Mr. Watts said Mr. Shrum had a shovel and at one point he felt threatened and he used deadly force to protect himself," Burnett said. The weapon used was a 9-mm pistol.

    Shrum's body has been sent to Nashville for an autopsy, Burnett said.

    The sheriff said authorities had investigated some prior incidents involving the two men but nothing had ever become violent.

    There were no other witnesses to Monday night's shooting, he said.

    "Right now, Mr. Watts has not been charged with anything. He's been cooperative and gave interviews," Burnett said.

    After consulting with the district attorney's office, "normally, we'll present it to the grand jury and let them decide if there should be charges," Burnett said.

    Meanwhile, investigators await autopsy results, he said.

    Cops: Man shoots brother in self defense in Clermont

    CLERMONT – A man who reportedly strangled his brother during an argument ended up getting the worst of the exchange when his brother shot him in self defense.

    On top of that, Jared A. Medeiros, 25, is facing charges of domestic battery by strangulation and domestic aggravated assault with a deadly weapon.

    Sheriff’s detectives were called to the Olympia Court home at about 4 p.m. on Dec. 27. Medeiros’ brother, Bryan, said he had to defend himself with his handgun after his brother put him in a chokehold. He said it was not the first time he was threatened. He said four days earlier Jared Medeiros pointed a firearm at him threatened to kill him.

    Jared Medeiros was flown to Orlando Regional Medical Center for treatment. He was taken to the Orange County Jail, where he was served with a Lake County warrant on the battery and assault charges.
