    Jan 3, 2017 the new PA legislators were sworn, have taken their oath support, defend and OBEY the commonwealth along with federal Constitution, with that act it officially starts the HBG 2017-2018 legislative session

    Along with Constitutional Carry other co-sponsorship memo are now starting to circulate in HBG including many ant-gun, that took that same oath and seem to conveniently forget about in 2 seconds afterwards with article one section 21 that they promised to honor:


    21.**Right to bear arms.
    The right of the citizens to bear arms in defense of themselves and the State
    shall not be questioned

    In the past two years, we have seen great victories for Pennsylvanians as we have worked to ensure their rights to bear arms and their right to defend themselves. However, this mission is far from over and there is still work to be done. In the near future, I plan to reintroduce legislation that will create a two-tiered system for the concealed carrying of firearms for lawful purposes in Pennsylvania.

    This legislation will provide a new system for concealed carrying of firearms for Pennsylvanians. The first level would no longer require law abiding citizens to obtain a permit to carry a firearm concealed in Pennsylvania. This principle acknowledges that Pennsylvanians have a fundamental constitutional right to keep and bear arms (Article 1, Section 21 of the Pennsylvania Constitution) and that no License to Carry a Firearm (LTCF) is currently required for law abiding citizens to openly carry a firearm throughout Pennsylvania. If a citizen passes a criminal background check to purchase a new firearm it is patently unjust and constitutionally questionable to add layers of bureaucratic regulations on those who are least likely to commit a crime just because the citizen prefers to carry his weapon concealed. Then when one examines the enforcement of the laws, against criminals, for ‘carrying firearms without a license’ the reasoning behind mandating a license ‘only’ for law abiding citizens quickly falls apart.

    The second level provides citizens the ability to obtain an optional LTCF permit that is valid throughout Pennsylvania and would provide for carrying firearms in other states (currently, 27 states either recognize Pennsylvania LTCF’s or a reciprocity agreement is in effect).

    This legislation defends the rights of the citizens in our Commonwealth and I urge you all to co-sponsor this legislation. Those Pennsylvanians that follow the law each day should not be punished or hindered if they choose to carry a firearm.





    This is a MAJOR change to the UFA, as you shouldn't first have to pay a fee and get permission slip from the government before exercising a Constitutional Right if you want to transport your firearm. No other Constitutional right has such restrictions!

    Rep Rick Saccone has introduced Constitutional Carry (HB 170) and is currently seeking co-sponsors for this important legislation.

    Constitutional Carry will create a two-tiered system with the carrying of firearms for lawful purposes:

    • Option 1 gives citizens the ability to obtain a (LTCF) License To Carry Firearm permit that is valid throughout Pennsylvania and would provide for carrying firearms in other states (currently, (32) states either recognize Pennsylvania LTCF’s or there is a reciprocity agreement in effect).

    • Option 2 recognizes that Commonwealth citizens have a fundamental constitutional right to keep and bear arms (Article 1, Section 21) and that ‘no LTCF’ is required for law abiding citizens to carry a firearm throughout Pennsylvania.

    It is a well recognized fact that criminals cannot and do not apply for LTCF permits. The statement (below) by Philadelphia District Attorney Williams underscores that reality:
    • District Attorney R. Seth Williams said the “85% of the homicides in Philadelphia are caused by handguns, with 99% of those being committed by individuals not licensed to carry and after having obtained the handgun illegally.”

    Currently in PA there is no License to Carry a Firearm (LTCF) permit required for law abiding citizens to openly carry a firearm throughout Pennsylvania. This principle acknowledges that Pennsylvanians have a fundamental constitutional right to keep and bear arms (Article 1, Section 21 of the Pennsylvania Constitution)

    If a citizen can pass a criminal background check to purchase a new firearm it is patently unjust to first require obtaining a government issued permission slip before exercising a right and constitutionally questionable to add layers of bureaucratic regulations on those who are least likely to commit a crime just because the citizen prefers to carry his weapon concealed.

    Then when one examines the enforcement of the laws, against criminals, for ‘carrying firearms without a license’ the reasoning behind mandating a license ‘only’ for law abiding citizens quickly falls apart.


    The enactment of this legislation into law will also benefit citizens exercising their ‘right to bear arms’ in a number of areas:

    • Transporting firearms - Currently in Pennsylvania it is a crime to transport a firearm (section 6102 definition) without a license except in four very narrow exceptions in the law unless the individual transporting a firearm has a LTCF permit. Stopping to refuel one’s vehicle or at a restaurant or even to going to a restroom without having a LTCF permit puts the unknowing, law abiding citizen in jeopardy of prosecution for a misdemeanor 1 crime.

    • Limit abuses of law abiding citizens – recent examples of incidents throughout Pennsylvania (ex. Mark Fiorino/Philadelphia) demonstrates that the licensing process and carrying of firearms by law abiding citizens is rife with problems and institutionalized prejudice.

    • Reform the issuance of LTCF permits – a number of urban centers in Pennsylvania have instituted policies and procedures that directly or indirectly conflicts with state law (section 6109). This legislation also clarifies the intent of the law and the legislature regarding these issuance procedures in numerous areas.

    • Removes the exemption for cities of the 1st class and restates the constitutional premise of equal protections.

    The political reality is going to be a series of pitched heated battles to get Constitutional Carry passed in law in the 2017-2018 session, so was all pro freedom legislation in the past were also a major endeavor, this will not be an exception.


    As the other side will scream and rant against this concept in many media venues, areas where ALL of you can post your comments to counter them.

    In HBG we all are going to have to come together to work with numerous legislators to get their support for passage
    The big push will come of the Monday May 22, 2017 for the annual PA 2nd Amendment is second to None Legislative Lobby event.

    So are you up for the challenge to regain your rights lost decades ago when the government converted a right into a privilege when a LTCF permit was required.

    IF you want this passed hoping don't get it done......Get active and contact the Reps and ask them to co-sponsor HB 170


    Freedom is not free

    IF you wish to have the benefits of Constitutional Carry, you are going to have to do some of the work by contacting the Reps, right now for sponsorship phase, hopefully with enough support from gun owners for the required votes in committees and house to get this on the governor’s desk for signature.

    Constitutional Carry - Issue Overview
    Rep Rick Saccone has introduced Constitutional Carry (HB 170) and currently is co-sponsored by 33 PA House members.

    Synopsis:
    Constitutional Carry is a situation within a state in which the carrying of firearms, concealed or not, is generally not restricted by the law, for law abiding citizens. When a state or other jurisdiction has adopted Constitutional Carry, it is legal for law-abiding citizens to carry a handgun, firearm, or other weapon concealed with or without an applicable permit or license.

    The law decriminalizes the carry of handguns for self-defense purposes without a license, and puts the burden upon a prosecutor to prove criminal intent of a person carrying a handgun. Also, there are no defined statutory limits as to ‘how’ a legally carried handgun should be carried openly or concealed; thus it is considered Constitutional Carry.

    Alaska enacted ‘Freedom to Carry’ in 2003 and all’s well. Texas enacted ‘Freedom to Carry’ "light" in 2007 as the Motorist Protection Act: there is no government interference with discreetly having a gun anywhere on your premises or in your vehicle (including any sort of motor home), and from your premises to your vehicle, an excellent start (you still need a license while out and about on foot, so they're taking it one step at a time, so to speak). Possessing a firearm is not a crime. And should not be a crime. What a concept. A woman should be able to put a handgun in her handbag and go about her day without fear of arrest. Montana enacted Freedom to Carry in 1991 for 99.4% of the state (outside city limits).

    Under the infringement of so-called "reciprocity" schemes (an odious feature of "right-to-carry" plans), your human and civil rights as an American have been reduced to a list of government-approved states for licensees only, when you leave your home state. The 98% of the public that refuses to jump through the hoops, be taxed, get on the criminal database and get "rights" papers is left out in the cold when they travel under the current "reciprocity" model. Enormous police effort that could be going directly toward reducing crime is instead being diverted into registering, regulating and tracking the innocent.

    Constitutional Carry will create a two-tiered system with the carrying of firearms for lawful purposes:

This bill would reinforce the principle that Pennsylvanians have a fundamental constitutional right to keep and bear arms (Article 1, Section 21 of the PA Constitution) and correct the flaws created in Title 18, Section 6106 as well.

    Since citizen’s pass a criminal background check to purchase a firearm’s it is patently unjust to require a government issued permission slip before exercising a right. It is constitutionally questionable to add layers of bureaucratic regulations on those who are least likely to commit a crime just because the citizen prefers to carry his weapon concealed.

    When one examines the anemic enforcement of the gun laws, against criminals, for ‘carrying firearms without a license’ the reasoning behind mandating a license ‘only’ for law abiding citizens falls apart.

    In New Hampshire a government granted Permission magic piece of paper along with paying a "Coat Tax" fee is no longer needed to exercise a Constitutional right to carry firearm in NH.

    THANKS to the efforts of the many ACTIVE gun owners in that state that constantly & never gave up lobbying the elected representatives

    AND

    Here in PA we can not even the same co-sponsors to resign to HB 170 as too few gun owners are NOT doing their part to actually contact the Reps and ask them to co-sponsor HB 170 ...sigh...

    Judging by the lack of comments here in this thread since the into to HB 170 guessing its not worth a little of your time to contact the reps to move this bill for ALL of the FREEDOMS it offers you

    More states allowing people to carry concealed handguns without permits

    New Hampshire this week passed a law allowing residents to carry a concealed handgun without a permit, joining a growing number of states that are allowing residents to carry weapons out of sight without a license.

    At least 11 states have passed laws allowing the concealed carry of guns without a permit, and 16 states have introduced legislation this year to do the same, according to the National Conference of State Legislatures and the National Rifle Association.

    Gun rights advocates see the laws as the next frontier in Second Amendment rights.*However, the legislation has been*controversial in many places where it has been introduced, with law enforcement members, politicians and gun proponents arguing that the bills go too far.

    “That’s kind*of the next step in expanding law-abiding gun owners’ constitutional right to self-protection,” said Jennifer Baker, a spokeswoman for the NRA’s Institute for Legislative Action. “It’s where a lot of states are moving.”

    Nationwide, the*legislation has been contentious and has failed in states that are traditional bastions of gun rights. The legislation has been dubbed “permitless carry” or “constitutional carry,” as proponents believe that people have a constitutional right to carry a gun with as few restrictions as possible.*Legislation is pending in states including Kentucky — where gun rights advocates expect it to pass — Texas, Colorado and Indiana.

    Idaho, Mississippi and West Virginia passed laws last year that do away with concealed-carry permits, allowing people to carry weapons without them.
    In New Hampshire, Gov. Chris Sununu (R)*signed a law on Wednesday that allows anyone who has purchased a licensed pistol or revolver to carry it, loaded or unloaded, on him or herself or in a vehicle. Sununu’s predecessor, Sen. Maggie Hassan (D), twice vetoed the legislation.

    “We have historically allowed people to openly carry a pistol. I don’t see why you have to get a second permit if you’re a law-abiding citizen and legally entitled to own a gun,” Jeb Bradley (R), the majority leader of the state Senate, said. Bradley and Sununu also said the law*puts New Hampshire on equal footing with neighboring Vermont and Maine, which also do not require permits for the concealed carry of handguns

    The legislation went into effect immediately. Previously, gun owners had to apply for a concealed-carry permit with the local police chief, who granted or denied the request.*Bradley said numerous people were unfairly denied permits, but police chiefs testified during hearings that few applications were turned down.

    “This bill will eliminate the state’s long-standing permitting system and prevent local law enforcement from making important determinations that help keep guns out of dangerous hands,” Portsmouth Police Commissioner Joseph Plaia said in a statement. He is a member of Granite State Coalition for Common Sense, an offshoot of Americans for Responsible Solutions, a gun control group founded by former Congresswoman Gabrielle Giffords.

    Shannon Watts, founder of Moms Demand Action for Gun Sense in America, said the passage of such laws are an “anomaly” and occur in “legislatures that have been doing the NRA’s bidding.”

    Montana Gov. Steve Bullock (D) vetoed a bill allowing for the carrying*of concealed guns without a permit on Thursday. Bullock said in a veto letter that the state’s sheriffs may require safety training before granting a concealed-carry permit and can deny permits to people struggling with mental illness. He equated the bill to allowing people to drive cars, fly planes or erect buildings without determining if they are eligible and able to do so.

    “While I will fiercely defend the 2nd Amendment rights of our citizens, I cannot support an absurd concept that threatens the safety of our communities by not providing for the basic fundamentals of gun safety or mental health screening,” Bullock wrote.

    South Dakota Gov. Dennis Daugaard (R), who said he is a lifetime member of the NRA, has vowed to veto a bill that would establish permitless carry in the state. South Dakota*does not require a permit to purchase a gun*and a concealed-carry permit costs $10 and requires a background check. In an op-ed in the Rapid City Journal, Daugaard wrote that he would not sign “bad legislation” that could have many unintended consequences.
    In Missouri, lawmakers last year overrode Gov. Jay Nixon’s (R) veto and passed a package*of gun legislation that established a “stand your ground” law and allowed people to carry concealed handguns without a permit.

    “The basis of this whole bill is that it allows law-abiding citizens to protect themselves and their families,” state Sen. Brian Munzlinger (R), the bill’s sponsor, said at the time. His office declined to comment on Thursday. Concealed-carry permits were no longer necessary in the state starting Jan. 1.
    The legislation sparked an outcry, with many concerned that it could put residents at risk and some public safety officials, including St. Louis Mayor Francis Slay (D), and the city’s police chief, Sam Dotson, said it would make neighborhoods less safe and make it more difficult for police to do their jobs.

    Burgum signs “constitutional carry” bill into law

    Thursday, March 23, 2017 - 10:00pm

    BISMARCK, N.D. – Governor Doug Burgum today signed legislation allowing law-abiding citizens to carry a concealed handgun if they have possessed a valid North Dakota driver’s license or state ID card for at least a year.

    The “constitutional carry” authority provided under House Bill 1169 applies only within North Dakota’s borders. Those wanting concealed carry reciprocity with other states must apply for a Class 1 or Class 2 North Dakota concealed weapon license, for which the requirements remain unchanged.

    Current law only requires an applicant for a Class 2 license to complete an open-book test, at a cost of up to $50, and undergo a criminal history records check.* Class 1 licenses require firearms training and additional requirements. Both licenses carry a $60 application fee.

    Under HB 1169, anyone who is eligible to possess a Class 2 firearm license and has had a valid driver’s license or state ID card for at least a year may carry a concealed firearm. Law enforcement officials recommended the state ID language, as well as the bill’s requirement that anyone carrying a concealed weapon inform law enforcement of the weapon during a traffic stop or other contact.

    Someone who has been convicted of a felony or crime of violence will still be precluded from carrying a handgun under this new law. Individuals who initiate the purchase of a handgun from a federally licensed dealer are still required to undergo a federal background check, which runs their name and descriptive information through three national databases.

    “North Dakota has a rich heritage of hunting and a culture of deep respect for firearm safety. As a hunter and gun owner myself, I strongly support gun rights for law-abiding citizens,” Burgum said. “House Bill 1169 allows citizens to exercise their Second Amendment right under the U.S. Constitution. It also is consistent with the North Dakota Constitution, which declares in Article I that all individuals have the inalienable right ‘to keep and bear arms for the defense of their person, family, property, and the state, and for lawful hunting, recreational, and other lawful purposes, which shall not be infringed.’ ”

    At the same time, Burgum – who has a Class 1 concealed weapons license that requires applicants to demonstrate firearms proficiency – noted that neither the existing Class 2 requirements nor HB 1169 have a firearms training component. He encouraged anyone considering carrying a concealed weapon to enroll in one of North Dakota’s many certified gun safety courses.

    “Gun ownership is both a right and a responsibility, and that responsibility begins with individuals and families,” Burgum said.
    No law enforcement agencies or groups testified against HB 1169. A representative of the North Dakota Peace Officers Association testified the bill is more enforceable because of the provision restricting it only to North Dakota residents and the requirement that those carrying a concealed weapon must inform a peace officer upon contact.

    “I ask legislators and law enforcement officials to closely monitor this new law with a continual focus on public safety,” Burgum said.
    The bill does not change the places designated in law as off-limits to conceal carry, including schools and publicly owned or operated buildings.
    House Bill 1169, which passed overwhelmingly with bipartisan support, takes effect Aug. 1, 2017.

    North Dakota Legalizes Constitutional Carry

    Second state to do so this year, 14th overall

    Republican governor Doug Burgum signed a bill legalizing permitless gun carry in North Dakota on Friday.

    The bill allows anyone over the age of 21 who can otherwise possess a firearm to carry it concealed on their person without having to obtain a permit beforehand. It does require that anyone legally carrying a firearm also carry a valid ID and inform police that they are carrying if they are stopped. The state's permitting process will remain in place for those who want to obtain one for carry in other states that have reciprocity agreements requiring a physical permit.

    North Dakota's new law comes on the heels of New Hampshire's adoption of permitless carry in February. A dozen states have now passed some form of permitless carry in the last decade, 13 have adopted the policy since 2003. Including Vermont, which never restricted gun carry, there are now a total of 14 states that have passed some form of permitless carry.

    Permitless carry, often called constitutional carry by proponents, remains the second most popular form of gun-carry policy in America. Eight states still have policies that allow government officials to deny citizens gun-carry permits regardless of whether they obtain the required training and pass a background check (currently the least popular policy). Another 28 states have policies requiring government officials to issue permits to citizens if they obtain the required training and pass a background check (currently the most popular policy).

    The trend of states adopting permitless carry seems poised to continue in the coming years. The policy has been gaining favor among Republican lawmakers and gun-rights activists. Since Republicans control every branch of government in 25 states, many of which have not adopted permitless carry yet, activists are confident more states will soon be on board.

    Gun-rights activists cheered the new North Dakota law as a step to leveling the playing field between the law-abiding and criminals.

    "This new law gives North Dakota's law-abiding citizens greater freedom to defend themselves and their families," Chris Cox, head of the National Rifle Association's lobbying arm, said in a statement. "Criminals carry guns, regardless of the laws. Permitless carry simply puts law-abiding gun owners on equal footing.

    "This new law gives law-abiding North Dakotans greater flexibility to defend themselves, their homes, and their families."

    I got generic response from an aide a few days later. To which i have taken to both her twitter and facebook.
    Ive also started randomly sending emails out asking for support in general and have been meaning to call her office or schedule a meeting.
    I just got a response from cartwright, will post somewhere. It was in response to general support of 2A rights.
