Never underestimate a prosecutor, their job is not to seek justice, their job is to get convictions, any way they can.

....any way they can includes rules of evidence and decorum which is far more constraining than "any way they can" vaguely implies.

It is possible to a degree to anticipate either side's use of established facts, but conjecture can easily reach the absurd if too much attention is paid it.

For example, I don't think I'll ever forget what a poster contributed to such discussion. He advised, "Do not carry your gun in a holster. Having a gun in a holster is evidence of premeditation to use the gun".

Being born and having the right to protect myself is the only preparatory action relevant to me, this is a bunch of internet BS that anything up to the point of "bang" can be twisted into this definition. I meant to shoot the perp your honor, and wanted it to be a good shot.

The internet talking heads are pros at over annalizing all bits of minutia
Whats next, cocked and locked, round chambered, handloads...ooh he had a flashlight and a laser on his handgun, give me a break

Yes, Hillary acted very illegally, and unethically to the point where even her Democrat leadership FIRED HER. Yet, the media never brings that up because they wanted the first woman President. Well too freakin bad!

One thing that can be argued against a "preparatory" type action against you = many guns require the hammer to be cocked before it can be used. And with such, cocking the hammer on a gun that doesn't require cocking should be irrelevant.

If a 1911 has to be cocked to be fire, then cocking a revolver or any other SA or SA/DA becomes a moot point.

Make sure the shoot is justified to begin with and the cocking aspect more than likely will never be of any issue.

I don't see any difference between cocking a revolver or carrying a 1911 in condition 1 or maybe activating a laser. Couldn't simply unholstering the firearm be considered a preparatory act? This kind of sounds like the old "don't carry custom loaded ammo" BS.
Anyone know of any cases where cocking a DA revolver resulted in liability?
As Rooster said: "If it ain't cocked and loaded it don't shoot."
