I didn't say she'd worry about it, just that if she attempted an EO that violates the constitution the SCOTUS could block it, like it did with Obama's EO to give amnesty to illegal immigrants. That being said, I totally whiffed on the point made by HighVelocity and BigAndy that she could fill vacant seats with judges that would interpret the constitution in her favor allowing her to have her way without pesky little distractions, like congress.

Honestly, I do think she hung around because she was convinced Clinton couldn't possibly lose. As were 91% of the voting population in DC that voted for her in November. Now, as you said, there's no way she's giving up her seat voluntarily.
