Interesting question brought up by my friend..

We were heading to the range today and my friend posed an interesting question to me. As I'm pretty sure if you are OC and your shirt falls over the top of your gun you are no longer OC and are now CC(Or so I have been lead to believe, correct me if I am wrong). He posed the question which I assume has the same answer. If you are carrying and you have an IWB but your shirt is tucked in behind the holster(IE the gun is essentially exposed from atleast the grip up), is this CC or OC still? Didn't know how to even search this one. Thanks!

I'm sue that a more qualified person will come along and correct me if I'm wrong but, I think that in the circumstance you described. It would be considered OC as the gun is still exposed, and it would be easy to tell what it is. But like I said, I'm not the most knowledgeable person on these matters.

I have to agree with Brown-Bear on this one. I also believe that it would be considered open carry. IMOA if any part is showing it is open carry. but IANAL

Concealed means "hidden from view"

If half the gun is sticking out it is not concealed

If you're wearing a black shirt and black pants with a black gun tucked IWB, it might be argued that it was concealed via camoflage. But I don't know if that'd hold water in a court of law.

My take is that with a CC license shirt in, shirt out, printing become a non-issue. I suppose I am legally covered, (no pun intended) across the board.

P.S. I have yet to intentionally OC except for around the house, although I am considering it for the comfort of getting this hunk of steel out of my waistband.

IWB, shirt tucked behind; OC
IWB, black gun w/ black clothes; Possible LEO hassle, but doubtful since in order for them to hassle you for having it CC, they'd have to admit to it being OC in order for them to spot it.
OWB, shirt covering gun grip, but not holster; OC
OWB, open muzzle holster, shirt covering grip, holster, but not muzzle; Tricky, would probably be able to defend in court, but still risky.
Pocket carry with a holster clip exposed on edge of pocket; Again, likely able to defend in court, but still quite risky.

With a LTCF, you also get the LTCFC (Liscence To Carry Firearms Comfortably), and no longer have to worry about OC/CC laws.

Another question then. I have a "Tuck This" IWB and the grip is barely visible in fact you would really have to know what you are looking at to tell it`s the backstrap. Is it open or concealed? What % needs to be visible? Does the fact that it`s sold or other holsters are sold as "concealed holsters" make them concealed?

At what point are we splitting hairs?

I hate Inside the Waistband, if I do use one of the IWB holsters it's between the belt and waistband anymore, I usually have a t-shirt over it anyways as to CC. Most days I just use a Belt slide holster as it's way more comforatable anyways.

Don't think there is an analytical answer (% exposure) specified anywhere. Just like the "reasonably prudent person in the same or similar circumstances' maxim used for interpreting other laws, I would hazard to say the gun is OC when its presence would be 'obvious to a reasonably observant person".
