    It should of never been entertained in any litigation, except for a judicial activist judge that let the case go forward contrary to black letter law which was made so under the Bush administration. Oh well, plaintiffs trying to sue gun manufacturers continues down the path of failure. I do not know of any case where the plaintiffs prevailed. Although, gun companies have spent a lot of money defending themselves in these frivolous lawsuits.

    She knows this would drive gun makers out of doing business in the U.S. For foreign manufacturers, their U.S. subsidiaries, and distributors would be sued, so they wouldn't sell here either.

    "An eventual appeal would continue to pile up attorney’s fees and court costs. Under the PLCAA, however, unsuccessful plaintiffs are liable for court costs and legal fees of the defendants. That’s something those who pursued a similar action after the Aurora cinema shooting discovered the hard way."

    For this lawsuit to be successful, the firearm would have to be proven defective from the manufacturing process, and this defect caused bodily injury or death.

    The defect laid elsewhere, which should be the target of the lawsuit. IANAL.

    Yet under the present lawsuit, the plaintiffs laid claim to "negligent entrustment" arguing the maker knowingly marketed and sold the Bushmaster AR-15 rifle to civilians despite knowing it posed a risk when used outside “highly regulated institutions” such as law enforcement or the military. Any appeal would have to be based on that claim alone.

    The problem there is/was twofold - first, the AR-15 has always been a "civilian" rifle design (the M-16 was based on the AR-15), and second, none of the defendants "entrusted" the rifle to the shooter - he killed the rifle's lawful owner, stole her rifle, and went on to commit multiple crimes with it.

    Facts, and laws don't mean anything to these gun grabbers. They will bring these law suits in the hope of getting an ultra progressive judge that will ignore the law, and facts. It won't stop as they will get Bloomberg or Soros money to fund them.
