Re: Ohio reciprocity for PA LTCF?
A company's policy is not part of what is called "constructive knowledge", which is a presumed state of mind by the law as to matters like statutory law or certain public records. "Company policy" is a private matter and must be actually communicated to others. The concept of constructive knowledge means that every citizen is presumed under the law to know certain matters, whether in reality he knows it or not. The ban on concealed carry in churches unless authorized by the controlling clergy is not a matter of company policy, it is written into the Ohio code.

Re: Ohio reciprocity for PA LTCF?
If you go into an establishment with an obvious no firearms sign you are trespassing and breaking the law. Yes the its same law that business can use to enforce dress code or any other barrier to entry. I doubt it's enforced much if you leave where you to be found out carrying, but its still illegal.
I know Ohio has specific legislation with potentially much stiffer penalties for carrying where posted. But that does not mean just because PA is only covered under trespassing laws that it is legal to carry where its posted."No, it's just a machine. I'm the weapon." - Jack Harper in Oblivion

Re: Ohio reciprocity for PA LTCF?
Not to bump an old thread, but could someone please update the main page of PAFOA to include Ohio in the reciprocity list? I usually trust the front page, at least for face value, when planning trips and I think a lot of others do as well. For all the people that come on here for help and advice, I think we need to get that updated to reflect correctly.

They are a bit stricter as to where you can carry. Also, a loadad magazine nearby an unloaded gun apparently translates to "loaded gun" under Ohio law. I've heard Ohio called a "minefield of legalities" when it comes to carry. Better know their laws very well before you just carry and forget.

I'm learning that with NC as well... looking them up for a wedding in a few months and man.. a load of crap! Almost makes me not want to go through the trouble, because we'll only be there for a couple days, and 99% of that time is going to be spent NOT being able to carry it, so it seems..

Re: Ohio reciprocity for PA LTCF?
Ohio seems to have a lot more private prohibitions against carrying firearms than PA does. When I was visiting my dad during his last months, every hospital or nursing home he was in had signs against carrying firearms. And the prohibition against consuming any alcoholic beverages is a real pain. Like I am going to go into an American Legion or VFW and not have a beer.

Re: Ohio reciprocity for PA LTCF?
the defiant trespassing legislation in the Crimes Code of Pa. pertains to an individual entering a property where he or she is prohibited from entering. If a person enters a property where entrance is permitted and is carrying an object that he is otherwise legally carrying, the defiant trespassing statute does not apply. The exception being that if such individual is asked to leave for carrying an object against company or private property policy and refuses to do so, a misdemeanor charge of defiant trespassing can be imposed on the individual. The other exception is a retired or active law enforcement member carrying under the LEOSA can be charged for carrying a firearm into an establishment against the owners or agent of the owners wishes. There is language in officers safety act that makes such a criminal violation, not only in Pa, but any other state.
