In Phila., appeals are handled by another city agency (Licenses and Inspections I think). Look at the denial and see what agency you sent the appeal to. I seem to recall there is a listing of appeals-thumbnail sketches. If you can find this listing you can read about similar cases that were and were not successful

I would like to know from the OP if he obtained his hearing date yet?
The A-holes at the City told me one month after I filed appeal for my hubby that they were so over-whelmed with appeals that they "behind". I waited another month (now 2 months after appeal filed) and was told over the phone that they had no record of any appeal being filed. I told them I had proof of delivery (signed certified mail green card) and they quickly "found" the paperwork. A few days later, I get hearing date in the mail for August.

I got my appeal notice within 2 weeks after filing. Date is set for August. Meaning, Many more months delayed

The evidence suggests that Philadelphia prides itself with keeping the number of people licensed to carry as small as possible. The guy in charge of Mayors Against Guns up there in Sullivan Law territory is probably feeding them a kick-back.

A friend of mine was denied a renewal because he did not list a conviction for some offense. He appealed on the basis that it had been expunged and therefore did not exist. He believed that the expungement made it as of it had never happened. He had access to legal representation through his union and took their lawyer with him to the hearing. The city has an outside attorney representing them. According to Gun Lawyer, he is a reasonable guy and can be persuaded by a good argument. The two lawyers conferred and came up with a solution. My friend acknowledged that he had omitted the conviction based on his understanding of the expungement. Since there was no ill will or bad faith in the omission, the city wiped away the finding of bad character and allowed the renewal. Focus on your understanding of the incident. Emphasize that you reported the incident in your application but did not understand that it had included a PFA. To you, the court proceeding was the story and not the little pieces that went along with it. Say you really do not recall anything about a PFA (because there might be apiece of paper out there with your signature that you no longer recall} if that is the case. Your intent in reporting the case in the first place to be open about the whole thing. Take a lawyer if possible.

Absolutely!! I reapplied for my LTCF May 24th. The officer that interviewed me said it will be within 45 business days.I knew that was not what the agreement says, but I just nodded and said ok. I say reapplied because my first application was denied due to a temporary PFA that I didn't know about. That was a quick rejection, a) PFA was active(later dismissed) b) My not knowing caused me to answer falsely. So it was a double whammy. I most likely would have won on appeal when PFA was dismissed. I just decided to reapply. I'm pretty confident now, but we'll see. Twelve calendar days and counting.

This was my experience with the appeal process:
My husband and I attended Philadelphia’s “Gun Court” on Tuesday, August 16, 2016 @ 12:30 p.m. The hearing was held at the Criminal Justice Center, 1301 Filbert St. Room 408. We waited approx. 6 months from the date the appeal was filed until the hearing date.
When you get to the Courtroom, you take a seat in the waiting area. In the front of this room are 3-4 interview areas (similar to the gun permit unit). The Courtroom where the hearings are held is down a hall from the waiting area.
My experience was similar to the one described above by Bill Gray. The City had an outside attorney representing them. I had an attorney, who is also a friend, with me. When we arrived, my attorney approached the City’s attorney and they quickly came to an agreement that the City would allow us to amend the Application. We were told to sit and wait until someone called us, and then my attorney left.
About 20-30 minutes later, an officer called us to the front of the room where we amended his Application. We were told a letter would be mailed by the gun permit unit in several weeks.
Now for the reason my husband was denied. When he applied for his permit, during the oral interview, he was asked, among other things, if he had ever been arrested. He responded yes, and explained, “when I was a kid, I was arrested for [this and that] ...”
Now, in Philly, your answers to the oral questions are written down and you are asked to sign the bottom of the page which is then attached to the your Application. So, if you tell them you were arrested 4 times when you were, in fact, arrested 5 times, you will be denied for these reasons:
- Failure to give accurate information; and
- Failed to cooperate and/or failed to give truthful answer (previous arrest)
So, basically, my husband forgot an arrest or two.
I saw at least two other individuals who were allowed to amend their applications while I was there. They were not represented by counsel. The officer who conducted my husband’s re-interview appeared to be working from a list and was calling people up randomly.
I hope this information helps someone in the future.
