    Default Loaning my Stepdaughter a firearm for home protection.

    I have a question about loaning my Stepdaughter a gun for home protection that would NOT leave her house.

    As far as I can tell, I could lend her a long gun but the wording I've seen about pistols is confusing.

    She does NOT have a LTCF. She will hopefully have that shortly. (Yes I know, it would solve many legality issues.) You can only lead a horse to water.

    I know i can't gift one to her because of the "step" thing, but my wife could gift her one of hers.

    This would only be a temporary situation. Thanks!

    Why doesn't your wife do the gifting thing if that solves any legal/liability issues?

    I'm thinking that is the best option for now but the ones transferred to me are more suitable than the ones transferred to my wife. I suppose I could gift one to my wife first, but that could get sticky if she actually needed to use it.

    Been trying to get her to get a LTCF for years. Life would be so much easier for everyone if children listened to their parent's advice.

    Why not "sell" a handgun to her? You know, it's not a gift if she pays a dollar. Then take her to a local gun shop and pay whatever $25 fee they charge for PICS and paperwork. The end result gives her an affordable means of self defense and meets the legal requirement.

    You say it will NOT leave her house but the fact is you cannot control what she does. What if she takes the pistol outside to investigate a strange sound? Flees the house during a break-in with gun in hand? Goes to the range and forgets it's in her purse/car/etc.... All these can be insured against if the gun is permanently hers and she has the LTCF. As long as it is a loan you will always own a percentage of the responsibility if anything goes wrong.

    She just dropped off the grandkids. Little did I know, she got her LTCF a few years ago.

    I believe you can loan a handgun out as long as the person is not prohibited from owning one.

    This gets a little sticky as to the color of law, but if this happened over a period of many months and wasn't to gift it to the step daughter initially, then it seems to work. I have a hand gun I want my stepson to have and I'm going the transfer route.

    Only if said person has an LTCF, or meets one of the other limited execptions.

    § 6115. Loans on, or lending or giving firearms prohibited.
    (a) Offense defined.--No person shall make any loan secured
    by mortgage, deposit or pledge of a firearm, nor, except as
    provided in subsection (b), shall any person lend or give a
    firearm to another or otherwise deliver a firearm contrary to
    the provisions of this subchapter.
    (b) Exception.--
    (1) Subsection (a) shall not apply if any of the
    following apply:
    (i) The person who receives the firearm is licensed
    to carry a firearm under section 6109 (relating to
    licenses).
