    Thumbs up POLICE: MAN, 65, SHOOTS ATTACKING DUO IN QUEEN VILLAGE

    QUEEN VILLAGE (WPVI) -- Philadelphia police say a 65-year-old man who was licensed to carry turned the tables on two men attacking him in Queen Village.

    It happened around 8:30 p.m. Tuesday at 2nd and Bainbridge streets.

    Investigators say the suspects had started accosting the man and his wife.

    "The verbal altercation turned into a physical altercation where the two shooting victims before they were shot started to assault the individual that later shot them. They were punching him and caused bruising to his face," Philadelphia Police Chief Inspector Scott Small said.

    Police say a 21-year old man was shot in the neck and a 20-year old man was shot in the stomach.

    Both were taken to Jefferson University Hospital for treatment.

    The District Attorney's Office will decide whether the victim will be charged or acted in self-defense.

    Very interested too see how this turns out for the shooter. My wife was asking me about something similar to this last week.

    Your being physically assaulted when does the right to use deadly force comee into play?

    When? Depends on the politics of the district attorney, police, area. In my opinion for some it's never.

    Lethal force is an acceptable response to assault.

    I saw this on Fox 29 (local Philly fox affiliate, typically pretty liberal). They actually treated in positively. I was shocked.

    The shooter should at least be fined for failure to follow the two center mass, one to head policy.

    I love how the feral urban yoots that initiated the altercation somehow became the "victims", and the guy that they were assaulting is an "individual that later shot them".

    Any bets on the length and scope of the criminal records for the 2 "victims"?

    Deadly force use is pretty clear. Only the information known and available to the shooter at the time the deadly force decision is made can be used to justify the application of deadly force. No information gained after the event, no matter how compelling for either side can be weighed. If the 65 year old man feared great bodily injury or death for he or his wife he should be justified. The problems arise when State officials, prosecutors and the like, believe that they are special and that their opinions and personal interpretations supersede the laws. Hopefully this man didn't make to many statements, falsely believing that the police are you friends.
