    Default Walmart getting sued for selling ammo!

    ALLENTOWN, Pa. --
    ''Families of three people killed in Pennsylvania last year are suing Wal-Mart, alleging the retail giant sold ammunition used in the slayings to a man who was underage and drunk.

    Wal-Mart employees in Easton were negligent in selling .38-caliber ammunition to 20-year-old Robert Jordain, failing to ensure he was at least 21 as required by law, the suit said.


    Jordain and two others have been charged with homicide in the July 5 deaths of a man in Easton and a man and a woman in nearby Allentown. The man who pulled the handgun's trigger that day is accused of killing seven people in two states.

    Wal-Mart said it will defend itself from the wrongful-death suit, which was filed last week in the Philadelphia Court of Common Pleas.

    The ammunition that Jordain bought could have been used in either a handgun or a rifle, and "the law allows for rifle ammunition to be purchased by someone 18 years of age," Randy Hargrove, the chain's director of national media relations, said in a statement.''


    Actually , under the old PA law , any ammo that can be used in either rifle or handgun must be sold as handgun ammo to someone over 21. Don't know if that's changed.

    A breathalyzer at the POS would have prevented this.

    The plaintiffs know that these thugs have nothing, so they're going after Walmart; the deep pockets. It's nothing new.

    Drunk driver crashes into a mini-van, killing 4 people?
    Let's sue everybody:
    • Apple Honda for selling the car
    • Sheetz for selling the gas that the driver filled the tank of the Honda with
    • Yokohama for making the tires that were on the car the night of the accident
    • Budweiser for making the beer that the guy drank
    • the company that made the bottle, can, or glass that the beer came in
    • the band that played at the bar that night - because they played a song that reminded him of his ex-girlfriend and he bought more beer to drown his sorrow
    • the credit card company for authorizing the charge at the bar
    • SUE EVERYONE - EXCEPT THE PERSON WHO ACTUALLY COMMITTED THE CRIME. It's not his fault.

    You learn something new each day, until this thread I never knew they had 38Cal rifles But then Wallymart has a leg to stand on IANAL. Also how do they know he was drunk when he purchased the ammo? do they have a Breathalyzer test for that time?

    After finally seeing the whole story I can see this is just a money run, they cant get anything from the shooter so they are grasping at straws for a payday. Looks like a car full of scumbags that were on their way to choir practice.

    The kid was 20 years old. Legally shouldn't have been able to purchase it. Unfortunately it's going to get skewed and set a really bad precedent.

    18 to but rifle ammo so what is illegal?

    I read it was 38 special. Handgun is different from rifle. It's nitpicking
