    Default NJ Resident Open Carry in PA, Concealed in Vehicle w/ Utah CCW

    I have read multiple articles, statutes, and posts on this issue I was hoping someone could clarify the exact legalities currently. I am a NJ Resident and I have both a Utah and Florida CCW License. If I were to travel to PA for say going to the range and upon entering PA take my handgun from the trunk, load it, and open carry till I re-enter my vehicle then conceal carry while in the vehicle and when leaving the vehicle again open carry am I in violation of the law? The instructor of the Utah CCW course said we could not, however my reading of the law is as long as one is licensed in any jurisdiction to carry concealed they can in their vehicle. Further reading of the laws of PA I believe anyone who is allowed to possess a handgun can carry open in PA other than Philly and prohibited places. Am I correct in my reading of the laws?

    Mostly. You shouldn't conceal, and you won't find the reason for it in the statute. A recent court case presided over by a drunken retard of a liberal activist judge
    left us with a decision that a person may only conceal carry in PA with a PA LTCF.

    Stick to open carry, stay out of Philly, and remember that you must stay 1000 feet from the boundary of school property in accordance with the federal
    gun free school zone act.

    Or you could do what I and others have done, stop the nonsense, move to America and enjoy a little freedom while we still have some left.

    Neither of your non resident permits are honored in PA so you cannot concealed carry anywhere in the state including your vehicle. You can open carry but you will have to deal with all the transport laws that come with it.

    ANY license is valid for carry in a vehicle, per statute.

    And AFAIK, while Commonwealth v. McKown made it so that PA residents can't rely on an out-of-state license to CC, I'm unaware of any valid suggestions that this extends to non-PA residents. ie - I believe a NJ resident CAN rely on a UT license to legally CC, even though you and I cannot.

    A PA resident has to have a LTCF now period. A resident of another state is still covered under any states permit for transport in a vehicle though.


    § 6106. Firearms not to be carried without a license.
    (a) Offense defined.--
    (1) Except as provided in paragraph (2), any person who
    carries a firearm in any vehicle or any person who carries a
    firearm concealed on or about his person, except in his place
    of abode or fixed place of business, without a valid and
    lawfully issued license under this chapter commits a felony
    of the third degree.
    (2) A person who is otherwise eligible to possess a
    valid license under this chapter but carries a firearm in any
    vehicle or any person who carries a firearm concealed on or
    about his person, except in his place of abode or fixed place
    of business, without a valid and lawfully issued license and
    has not committed any other criminal violation commits a
    misdemeanor of the first degree.
    (11) Any person while carrying a firearm in any vehicle,
    which person possesses a valid and lawfully issued license
    for that firearm which has been issued under the laws of the
    United States or any other state.
    So as a NJ resident he could possess a gun in his vehicle under any states reciprocal permit. Now in order to conceal it he would need a permit from his home state. Since that's impossible for a NJ resident he would have to oc and follow all the rules for someone who doesn't have a permit. The Mcowen ruling screwed this up for PA residents in that the judge ruled a PA resident is not "Any person".

    UT resident permit is good. Kane altered reciprocity agreements with several states, so now we only honor residents of those states permits. We no longer honor nonresident permits from them possessed by people from other states. UT was one that she altered.

    Agreed.

    I'm still not sold that ALL non-resident licenses are now invalid for non-PA residents as a general rule. One would just need to rely on a license from a state that hasn't had it's agreement modified by Kane. So while it has gotten more difficult, it's not impossible to accomplish.
