    It won't be long before someone wins an 'ignorance of the law' case because of crap like this. If the ATF ever starts asking me questions, it will be two steps... 1. Lawyer, 2. Jury trial. If number one dosen't like number two, rinse and repeat.

    The hubbub comes from a misreading of the definition of "firearm", and the importance of the word "or":

    "Firearm." Any pistol or revolver with a barrel length less than 15 inches,

    any shotgun with a barrel length less than 18 inches

    or any rifle with a barrel length less than 16 inches,
    or

    any pistol, revolver, rifle or shotgun with an overall length of less than 26 inches. The barrel length of a firearm shall be determined by measuring from the muzzle of the barrel to the face of the closed action, bolt or cylinder, whichever is applicable.


    No matter what else is going on with your AR pistol, if it has a barrel length under 15", it's a "firearm". Same applies if it has a 17" barrel and telescoping bolt/receiver that keeps the OAL under 26". That's why we can legally carry a registered SBR in a car, loaded, under our LTCF, if ANY of the listed factors apply.

    What I worry about, is does the officer who pulls you over know what the OAL for a pistol are?

    It would suck to spend a couple nights in jail while he checked.

    Thank you for the correction!

    I would hate to see someone become a victim because some officer decided to measure your rifle. Chances of that happening are slim but still possible if they see fit.

    I thought a ar lower (non pistol marked) can be made into an AR pistol (upper less than 16") as long as no buttstock has ever been installed?

    Provided the lower was built as a pistol first. If it was built as a rifle first it can't be rebuilt into a pistol. If it's built as a pistol first it can be rebuilt into a rifle, and back to a pistol, and back into a rifle at your leisure. Another goofy ATF rule.

    Thanks for the replys guys, what I'm getting out of this is that it would be legal if it met any one of the criteria ( under certain barrel length or oal) since it states or, but I think I may go with the 10.5" since that would put me under both lengths possibly avoiding an officer that would interpret the law differently. Unless I find a good deal on a 11.5 haha.
