    forwarded by a fellow Pennsylvania Activist

    Shira Goodman is the foremost anti 2nd Amendment activist in Pennsylvania.

    We now know where Pennsylvania Senator Toomey stands.

    NSSF has learned that anti-gun U.S. Senators are expected to bring up a vote
    at ANY MINUTE this afternoon on the previously defeated Manchin-Toomey
    "universal background check" amendment as well as an amendment expanding the
    prohibited persons list to anyone unknowingly placed on a secret,
    error-prone government list, the so called "terrorist watch list."

    Call your senators at 202-224-3121 as soon as you can and urge them to vote
    NO on both amendments.

    Friends,

    Senator Toomey just called our office. He wanted to let us know that he and
    Senator Manchin plan to re-introduce the Manchin-Toomey background check
    expansion bill.

    This afternoon, when the US Senate tackles some budget business, it is
    likely several gun policy amendments will come up. The Manchin-Toomey
    background check expansion bill will be one of those amendments.

    We need to thank Senator Toomey for standing firm in his support for this
    important measure that will keep guns out of the hands of those who should
    not have them. And we must also ask him to support commonsense policies like
    closing the Terror Gap that allows folks on the do not fly list to buy guns.

    Why the Firearms Industry Opposes so-called
    “Universal Background Checks”


    BURDENSOME - Federally licensed firearms retailers will be burdened with having to perform a governmental function (background check on private party transfers). Many proposals mandate that the dealer perform background checks on private party transfers, but cap the fee a dealer can charge:
    a. The time and effort necessary to perform the check at government set fee is inadequate to cover the retailers cost. Must maintain A&D records and the Form 4473 for 20 years.
    b. FFL status can be jeopardized by mandatory record keeping requirements imposed by Federal (and State) laws. A retailer could have their FFL revoked for a record-keeping error in the paperwork for a gun they didn’t actually sell.


    LIABILITY EXPOSURE - Federally licensed firearms retailers will have liability exposure, e.g. product liability claims arising from an accident involving a firearm they didn’t sell, and for which they may thus have no insurance coverage; a property damage claim (“you damaged the gun.”)


    NICS DELAYS - Firearms retailers are very concerned that “universal background checks” will result in very lengthy delays in conducting NICS checks when they sell a firearm from their inventory. Proponents of “universal background checks” claim 40% of gun transfers are not subject to a background check. A 40% increase in NICS checks will cause the NICS system to crash. The system simply can’t handle such an increase in volume; delays are growing unacceptably long now even without “private party transfers.”


    FixNICSSM - The current background check system is broken. The background checks that are currently done are not as accurate and complete as they should be. This is because both the Federal government and about half the States have failed to put into the NICS system all appropriate records pertaining to prohibited persons, such as mental health records. “Universal background checks” will simply produce more inaccurate and incomplete checks. Before we talk about requiring background checks on private party transfers, we should FixNICS.” Members of the firearms industry, through the NSSF, are funding a grassroots campaign called FixNICS to encourage the reporting records of prohibited persons.


    “DEMAND LETTERS” - ATF could further abuse its “demand letter” authority by sending a “demand letter” to all dealers requiring them to submit to ATF a copy of records pertaining to private party transfers (checks) that they are required to maintain. This has happened already to certain dealers.


    REGISTRATION - According to the National Institute of Justice, “universal background checks” are only effective if there is national registration of all guns and all private party transfers.


    UNDEFINED TERM - What exactly is meant by “universal background check”? Some proponents insist it applies any time a firearm is exchanged between any two individuals. Will intra-family transfers be included? Gifts between friends? Inherited firearms? A loan of a firearm to a hunting buddy during a hunting trip?


    FAILURE TO PROSECUTE - Both the Federal and State governments are not prosecuting those who fail a background check when illegally attempting to purchase firearms now. Why would we think the government is any more likely to prosecute criminals who try to illegally obtain a firearm through a private party transfer if they are unwilling to prosecute those who fail checks performed by licensed retailers?

    Terrorist Watchlist Fast Facts

    It is unacceptable to deny Americans their Second Amendment rights
    without due process because they were placed on a government list or
    their name is similar to a name on the terrorist watch list.

    • There are major problems with how names are added to the list and
    errors are rampant. If placed onto the secretive list erroneously, it is
    difficult to be removed.

    • It is easier to be placed on the Terrorist Watchlist than the No-Fly list,
    although there is no Constitutional right to fly.

    • If such a law were enacted, the list would serve as a Terrorist
    Notification system, as terrorists could find out whether they are on
    the list simply by attempting to purchase a firearm. The current system
    more appropriately allows law enforcement the chance to scrutinize
    suspected individuals.

    • We all support the goal of preventing domestic terrorism. Dangerous
    terrorists and criminals should be included on law enforcement wanted
    lists or should be charged with a crime. Either action would prohibit
    these individuals from purchasing firearms.

    is the Transportation Security
    Administration (TSA) No-Fly List.
    The watch list, which contained
    more than 1.1 million identities,
    including aliases, as of the end
    of 2008, is fraught with errors.
    A 2009 Department of Justice
    audit of the terrorist watch list
    nominating process found that
    several major problems with the
    nomination practices including
    names not added that should have
    been, former subjects of closed
    investigations that were supposed
    to have been removed years ago,
    and deceased individuals.iiIn 72
    percent of the cases reviewed, the
    individuals were not removed “in a
    timely manner.”
    The FBI may nominate individuals
    to the watch list that aren’t the
    subject of a terrorist investigation.
    More than 62,000 watch list
    records were created through
    this process. The audit found
    “the controls over these types
    of nominations to be weak or
    nonexistent.”iii Since these
    proposals would prevent anyone
    whose name appears on the list
    from purchasing a firearm, even
    individuals, such as the late Senator
    Ted Kennedy, who merely have
    continued on back

    similar names to one on the list,
    would be prevented from exercising
    their constitutional right.iv
    Current System Works
    There are already methods in place
    to prevent terrorists and criminals
    from legally purchasing firearms.
    More than 95 percent of people
    on the watch list are automatically
    prohibited from purchasing firearms
    because they are not American
    citizens or legal U.S. residents.
    The citizens that appear on the
    watch list would only be allowed
    to purchase a firearm if they meet
    the current guidelines and pass a
    mandatory FBI background check.v
    The FBI checks its Violent Gang
    and Terrorist Organization File for
    every background check. Federal law
    already bars felons, unlawful drug
    users and those with misdemeanor
    domestic violence convictions from
    purchasing firearms.
    Terrorist Notification System
    These proposals are unlikely to
    prevent a terrorist attack, as most
    would-be terrorists are either not on
    the list before they commit crimes,
    or are prohibited from purchasing
    firearms under existing law.
    However, the proposals would hand
    terrorists a useful tool: a governmentrun
    terrorist notification system.
    According to a 2005 Department
    of Justice (DOJ) letter to the
    Senate majority leader, the DOJ
    strongly opposes such a system
    since it would “jeopardize ongoing
    investigations” and “would alert [a
    suspect] that he or she is on the
    watch list.” Even the TSC cited a
    2010 Washington Post article in its
    reason for opposing such a system,
    saying “There are legitimate law
    enforcement reasons for keeping
    the list secret: Disclosure of such
    information would tip off known or
    suspected terrorists, who could then
    change their habits or identities to
    escape government scrutiny.”
    Merely being suspected or simply
    having a name that is similar
    to someone who is suspected
    should not be enough to deny any
    American any fundamental right.
    Legislative attempts to prohibit the
    purchase of firearms by anyone on
    the terrorist watch list are overly
    broad infringements on Americans’
    constitutional rights and attempt to
    solve a problem that doesn’t exist by
    using a method that wouldn’t work
    and would provide a tool to terrorists.

    They were voted down. The State run media is in full propaganda mode making wild claims that the Republicans are allowing terrorists to have guns. /sigh/

    I may be mixing up my votes,mouth it sure looks like Toomey voted against the whole "no guns for people on the terrywrist watch list" and then for his own bill.

    He's still a fuckstick, but nothing like getting hit by cars coming both ways. The ceasefire folks only got 1 of 2 votes out of him.

    Yes.

    I think the libtards are in a frenzied hysterical state. They have a mountain to climb to seize the presidency in 2016 with dragging hillary clinton across the line and also have lost ground in congress and senate races and state governments as well. Without the utopian statist king obama around, they could go a long time before they have their big chance again, so expect irrational crazy rhetoric and behavior for the next year at least. I can see it on our Senator and Congressman's social media sites and in left wing drive by media with comments sections. These people are riled up crazy and are extremely dangerous.
