    Doesn't work that way. Plenty of people end up with prohibiting convictions that were just minding their own business.

    Very confused if it is legal to open carry a firearm in pa how can you be charged with carrying a firearm without a license and charged with position of a firearm.I must be missing something with this I saw on a nother article the same thing person was charged for having a firearm without a license. If someone could explain what I'm not understanding I would appreciate it.

    It could be a couple of things.

    1. Did the individual get into or out of a vehicle? The second you get into or onto any vehicle you need the license.

    2. Did the firearm become concealed? If your concealing you need the license. This is where a lot of people get charged with this I believe.

    3. Is the person in Philly? OC requires the license in Philadelphia.

    4. Was the person in a school zone? You need a license to be within the 2
    1000 ft gun free school zone.

    That's 4 off the top of my head that could lead to charges of possession or carrying without a license. A lot of people hear about PA being an open carry state and think you can just strap on a owb holster and be good to go about your daily routine. That's not really the case though. In order to oc without a license you have to stick to some fairly strict exceptions to the law.

    It is very simple. Open Carry is allow without a license in PA except for Philly and declared state of emergency. Carrying concealed or in a vehicle including a motorcycle or bicycle requires a license. This is how I understand PA's carry laws. To be safe, get a LTCF.

    If a law is so complicated that the average person cannot understand it then the law needs to be changed or simplified.

    It's so complicated we have to pass it before we can know what's in it. One caveat: Ignorance of the complicated law is no excuse.

    I've always got the impression that laws are complicated and poorly defined so law enforcement officials and prosecutors can manipulate them to their benefit. I can think of 1000 laws that can be interpreted 100 different ways. However, the only interpretation that matters is the one cops and prosecutors use to accomplish what they want to accomplish.
