    Default Purchasing a firearm while on ARD/Probation

    I need advice on purchasing firearms while I'm on ARD/Probation... I was placed on ARD for my first DUI offense for one year; however I was placed under arrest for a second DUI offense with an upcoming ungraded misdemeanor while on ARD. Both offenses under my name are ungraded misdemeanors. I'm expected to be revoked from the ARD because of the violation.

    I'm looking into purchasing another 1911 and I double check on the firearms application of sale of the firearms that I already purchased; set aforth the rules and regulations listed on the application for purchase, nothing with two ungraded DUI misdemeanors or ARD that prohibits me from possessing firerms has ever been mentioned. I have several questions, should I attempt to purchase hence answer truthfully on the application?

    Will PICS be alerted or they just don't care because nothing in the application/record of sale section prohibits me from purchasing firearms however the problem is the ARD...

    Has anyone have any experience purchasing firearms while on Probation? Both DUI offenses occurred in Williamsport which is in Lycoming County...

    Any comments or opinions will be a big help, thanks!

    Isn't it usually a condition of probation that you can't purchase any firearms?

    Yea, one of the conditions but there is a section on the document prior to signing an agreement to the extension of the ARD that says if convicted of M1 or any felony, then you are barred from owning or possessing firearms and ammunition. You can't combine the condition of the ARD with a M1 or felony on the ARD if it is not on the application sale... It can be confusing tho.

    You need to talk with an experienced lawyer before even thinking about it. I assume you have one. Pa has been going after people who lie (or make mistakes) on filling out the PICS form.

    The last thing you need is a third legal problem in a year (and this one could be a felony).

    Do not even think about it! You will be denied. I am 100% positive. And once you are denied, dont be surprised if the PSP comes knocking on your door. Trust me on this one, I hate to see bad stuff happen to people, even when they dont make the best decisions.

    Maybe you should stop drinking and driving. Once you have that under control you should contact a lawyer about buying and owning firearms. Good Luck.

    2 DUI s and bingo you are prohibited. You proved yourself not capable of good judgement and an alcoholic. If drinking has caused you problems and you continue to drink, you are defined as alcoholic. The last thing you need is a 1911. They will get around to your currently owned guns. Arrange with a lawyer to sell them while you can. I'm not a lawyer. You need one. I'm not a doctor. You should consult one. Good luck on your journey. Addictions kill. Don't be a statistic. Think of other people.
