    Default LTCF Denial

    A friend of mine was just denied a LTCF in Philadelphia. Has anyone else had this happen and if so, how did you handle the appeal? Do you mail the form in and they schedule you a hearing date? Or do you just fill out the form and go to the room the days they hear appeals?

    Did it state a reason for the denial?

    How the "character clause" is Constitutional is beyond me. It basically renders PA to a "May Issue" state, and not a Shall Issue state.

    He was arrested years ago for using his weapon to defend himself. He had a shitty lawyer who advised him to plead no contest. He is still able to purchase firearms, so the charges couldn't have been that serious. I'm just wondering what the process is though. Not what he "should do".

    The "character clause" is a catch-all that Philly loves to use. From petty crimes to unpaid parking tickets. Even if the record is expunged, Philly will still probably deny. It's what they do.

    Here are the LTCF number for Philly and surrounding counties by percentage:

    Philly - 0.5%
    Montco - 1%
    Delco - 1.2%
    Bucks - 1.7%

    Philly has 1.5 million people and only 7000 (or so) LTCF holders.

    Based on this I recommend your friend get a lawyer if he really wants his lftcf.
    No way Philly's pretend appeal board is going to roll over on this. It can't hurt to try, but he only has 30 days to appeal to a real court (common pleas), or he has to wait one year before re-applying.
