I am going to talk to another lawyer, (one that seems to know what they are doing) and see what my options are.

There were witness's, but they changed their story after the first pre-lim.
Naturally, I had the gun, so I was the bad guy.

What pisses me off the most is that it was my OWN borough. There are only about 3000-5000 people that live here. I told the cop that I was physically assualted and the let the other guy go free.

I sense something isn't quite right here. Too many vague "descriptions' of persons and transactions and too much withheld, making it hard to offer anything of value, other than best wishes for a good outcome.

OP stated the altercation occurred at the rear of his vehicle, unless he could have maneuvered in font of the camera, I don't think it would of been that great a help.

I assume the other guy did not live in the borough?

Not trying to be smart, but simply because you live in the town where it occurred, does not make one automatically right.

From the info in your story his actions didn't seem to arise much above simple assault which is usually a private criminal complaint. Without any bruises or cuts the cop won't be arresting him.

Frequently in these sorts of things, what was said matters as much as what was done. Dash cams with sound and video will probably pick up the sequence of the argument, the tone of the aggressor, and other useful stuff.

And the fact that he was cut off. Besides, It isn't difficult to put one in the rear window, too.

From the story it seems like a fist fight till the gun was drawn. Verbal threats vs pulling a gun on an unarmed man. Honestly i cant see the argument. I understand he put hands on you but instead of drawing a weapon wouldn't the SAFE thing to do would be get in your vehicle, call 911 and proceed to a safe area?

Why would you post "it seems like a fist fight till the gun was drawn. Verbal threats vs pulling a gun on an unarmed man".

Do you understand the difference between "verbal threats" and "a fist fight"?

Nobody is obliged to submit to a beating just because the aggressor is younger, tougher, and unarmed. A verbal threat of a beating is no more nor less painful than verbal threats of a shooting. The OP met credible threats of unlawful attack with equally credible threats of deadly force.

And your assumption that an older guy could simply get into his car and drive away, or fend off a violent man with the 1/8" thick glass of his window, seems unlikely.

If this had been on video, and it played out as we're told, it would have been considered legitimate self-defense, a "defensive display".

You aren't required to allow thugs to beat you senseless and then steal your gun and car and wallet. The law distinguishes between "use of deadly force" and "threats of deadly force", even if too many cops and DA's are kind of fuzzy on the issue because they despise guns in our hands.
