    Well after many twist and turns over coming opposition by amending to other bills, along with several sessions of efforts to seek passage.... we (all of us) got the legislators to remove the prohibition on the use of semi-auto firearms for hunting in PA and signed into law by Governor Wolf

    HB 366 Hunting with Semi automatic Rifles – Rep Saccone 2015-2016 legislative effort

    There are numerous PAFOA thread and discussions about the legalization of Hunting with semi-auto rifles in PA.

    Respectfully Requesting from ALL ... How about keeping the focus of this thread on seeking passage. Got a constructive question!

    Hunting with Semiautomatic Rifles, former HB 2333


    In the near future I plan on introducing legislation that would amend Title 34 section 2308 Unlawful Devices and Methods to allow hunting with semi-automatic rifles in Pennsylvania. More specifically it would allow hunting with semi-automatic center fire rifles limited to a five shell capacity and .22 caliber semi-automatic rim fire rifles with a built in capacity limit.

    Currently, we are one of two states forbidding such hunting. Even Hawaii, California and New York allow hunting with semiautomatic rifles.

    Pennsylvania hunters have proven for decades that they are trustworthy, responsible and ethical stewards of Pennsylvania’s hunting/sporting heritage.

    It is time Pennsylvania joins the rest of America in allowing hunting in this regard.

    Amending Title 34 (Game) of the Pennsylvania Consolidated Statutes, in hunting and furtaking, further providing for unlawful devices and methods.
    The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:
    Section 1. Section 2308(a)(2) and (3) of Title 34 of the Pennsylvania Consolidated Statutes are amended to read:
    § 2308. Unlawful devices and methods.
    (a) General rule.--Except as otherwise provided in this title, it is unlawful for any person to hunt or aid, abet, assist or conspire to hunt any game or wildlife through the use of:
    * * *
    (2) A semiautomatic [rifle or] pistol.
    (3) [(Reserved).] A semiautomatic centerfire rifle, unless the semiautomatic centerfire rifle is limited to a five-shell capacity, not including the rifle's chamber. This paragraph includes a semiautomatic rimfire rifle in .22 caliber without an ammunition capacity limit.
    * * *
    Section 2. This act shall take effect in 60 days.
    Guys and Gals let’s focus on working on changing the laws we don’t like by contacting the Reps and let them know how you feel. Without that we GOT NOTHING

    Rep Saccone HB 366 just removes the prohibition from semi-auto rifles be allowed to use for hunting in PA

    Then it will be up to the PGC to determine what semi-auto rifle they will allow the option to hunt what is PA where and when.

    Last session effort it was a 10 round limit, due to some hunters complaining that hunters in PA are less responsible than the hunters in others states are.

    To overcome the loud opposition from some hunters, the round count for semi-auto center fire rifle was lowered from 10 to 5 rounds capacity (not counting the chamber).

    IF you want to plug or restrict your semi-auto rifle capacity rifle magazine, there is no reason you couldn’t and still comply with the restriction.

    You can see from other states they trust their hunters to not load more in the magazine without be plugged or pinned.

    The PGC could also give you that same “honor system” option but only after this is passed into law, much like they do at the PGC public shooting ranges.

    PLEASE NOTE in the six adjoining states to PA restriction on hunting with semi-auto rifles and magazine capacity.

    Really it’s not the type of action that is the problem with slob hunter’s irresponsible use of a firearm, it’s our job to police them when they act irresponsibly with firearms. IF you know firsthand stories of people shooting indiscriminately and recklessly as fast as they can in a dangerous manor and you did nothing or said anything to the offenders at that time on just how wrong that was, that is on you.

    Look at it another way, If you are at a range and you see firsthand people miss handing firearms in a dangerous way that threaten everyone around them and don’t do anything and still stay there, who’s fault is it then?

    Wouldn’t you own a piece of any tragedy by your silence approval of their actions? When you could have did something to prevent a future accident from happening by pointing out the safety factor, some people just don’t know any better.



    IF you even want the chance to hunt with your favorite semi-auto rifle in PA

    HOW ABOUT CONTACTING the Reps listed and asking them to co-sponsor HB 366


    Right now we got NO semi-auto rifle hunting option unless you want to cut your hand off, then it’s legal to hunt with in PA with semi-auto rifle with a magazine limit.


    Some always ask will this proposed legislation move this session?

    Well that all up to you and how many other hunters you can influence that also want this change, also by you keep on contacting the Reps till we get a vote.

    This is a title 34 bill, it’s in Game and Fish committee which means it not stuck in the usual title 18 Judiciary Committee road blocks where in the past, pro-gun bills with over a hundred co-sponsor (half the house as sponsors) couldn’t even get a hearing let alone a vote in JC and anti-gun bills with less than 20 sponsors got 3 failed JC votes.

    This is a case of being the squeaky wheel that gets the grease, IF you want this do your part and contact the Reps listed in OP.

    There was about 650,000 adult hunting licenses sold for 2014 get only 3% of that number about 20,000 hunters constantly bugging and contacting the Reps wanting this passed.

    You would be surprised how fast HB 366 would move.

    If its only 2,000 that are willing to get involved its going to a lot of work, if its only 200 that are willing it could take several sessions for this to pass till we can get enough other hunter that want this change to get involved.



    Here are some talking points you can use to lobby for change

    48 states its legal to hunt for something in those other state without any extra problems because of the type of action, you can note other PA surrounding states

    With some semi-auto rifles that come with adjustable stock, it makes it easily adaptable to younger hunter or woman, without buying another rifle.

    Somethings to consider about why to legalize semi-auto firearm for youth, woman and even older men hunters.

    One big downside to a manually operated rifles, when compared to a semi-automatic rifle is felt recoil. Larger calibers, from some favorite deer calibers such as the .30-06 on up, generate heavy recoil the average shooter may not tolerate well. Gas-operated semi-autos attenuate this recoil.

    Another plus favoring semi-autos is faster reloading for follow-up shots. Combine less recoil for eliminating muzzle jump with faster loading and getting the sights or crosshairs on target for a second or third shot IF its required and the semi-auto wins out over the bolt action to humanely harvest game.

    The reduced recoil and follow up shot is why you will see semi-auto shotguns so often used by PA hunters.

    These are some of the main reasons for allowing PA become the 49th state to allow semi-auto rifles for hunting as this change will retain and help recruit new hunters to carry on the all of recreational activity that hunting provides.

    But, the pros far outweigh the cons if you ask me. The removable box magazine is a notable convenience. If you are doing a lot of getting in and out of vehicles, such as when calling predators, it makes loading and unloading the rifle simple. For the big-game hunter, an extra loaded magazine in a pocket provides a fast reload. Where it’s legal, the ability to use a higher-capacity magazine is helpful, for example, when shooting prairie dogs. If you pre-load a bunch of higher-capacity magazines you will get in a lot more shooting than your buddy who is loading his bolt-action again and again.

    The pistol grip design is another advantage for some hunting situations. For example, when calling predators it is a smart policy to keep the rifle up and ready. Sitting with the gun on your knee or on a bi-pod, (which is easy to do with the round fore-ends of AR rifles) and the stock on your shoulder can tire your trigger hand with a conventional stock design. The pistol grip puts the hand in a more natural position and reduces hand fatigue. It may sound trivial here, but after a long day of coyote hunting it is anything but. The pistol grip also provides a handle for an alternative way to carry a shorter-barreled rifle.

    Speaking of predator hunting, I have seen some elaborate and odd systems to mount a light on a bolt-action rifle for hunting at night. But, with an AR, you simply attach it to a rail mount. Most AR-type rifles have several locations either with a rail or designed to add a rail. These rails offer lots of options including said flashlight, secondary sighting options, extra ammunition and just about anything else you would wish to attach to the rifle. They also provide the option of quickly switching scopes. More than once I have seen a hunt ruined by a damaged scope. It takes less than a minute to switch to another pre-zeroed scope and you are back in the hunt.

    If you are like me and hunt a lot in the north where it’s cold during predator hunting season, the adjustable buttstock that is a common option on AR-type rifles is a great addition. With short arms and thick shoulders I find it hard to shoot with a full-length stock and enough clothing to keep me warm in a sub-zero wind. But, by shortening the length of pull with the adjustable stock, things are cool again. (Pun intended.)

    Finally, I see two more big reasons to use these rifles for hunting. One is that they are fun. I have always been attracted to guns that are a “little different,” and with an AR-style rifle you can be the guy in camp with something on the cutting edge. The second and more serious reason is to make a statement to misguided politicians—who would take these rifles away from us—that they are wrong.

    DISCLAIMER we did the research on the 49th other states allowed hunting with semi-auto center fire rifle and semi-auto rim fire rifles in 2012 time period and IF there was any magazine capacities limitation in each state, not on what species of animal that could be hunted with what.

    We really only looked at was it was legal for semi-auto rifle to hunt with in each state and what if any round limitations. Not what you can blast with any type of action of firearm, HB 366 doesn't deal with what you can hunt with in PA either!

    Some states have a prohibition against hunting deer modern center fire rifles, yet they still allow semi-auto rifles to hunt something in their state. Pa you are prohibited from hunting with semi-auto rifle (semi-auto pistol) unless you have one or both hand amputated.

    PLEASE DO YOU OWN REASEARCH before you assume that PA is such a hunter friendly state because you will find we are not!

    Example lots of state you can hunt with: Semi-auto pistols, air rifles, and on Sundays all still prohibited in PA. We have made progress over the last several years with crossbows and a limited inline muzzleloaders season but we are still one of the few that have only flintlock season.

    There are BIG PICTURE issue here with making semi-auto rifles that many never even think of.

    For many year anti-gun politicians have used the statement that semi-auto rifle have no lawful sporting purpose, along with standard capacity magazines as reason to ban them (if they hold over 10 rounds). You will often hear them say “why does a hunter need more than one shot to kill something”. Don’t be a anti-gun stooge, by support gun control lite

    This creating a sporting purpose is especially important here in PA even for all of those that don’t hunt, this the reason why you should support this effort as it provided more lawful reasons for not banning standard capacity magazines and more regulation on semi-auto rifles.

    Keep in mind

    The PGC would still have the discretionary authority to limit semi-auto rifles use much as it bans modern center fire rifles for hunting in certain urban area.

    Rep Saccone semi-auto rifle HB 366 just removes the title 34 legislation preventing PGC from allowing semi-auto rifles use in PA. It will still be up to the PGC to say what it could be used for what specie of animal and when and even limit how many LESS round are allowed to into any firearm for hunting this or that specie of animal.


    Back to making the case for more reason to change PA and bring it into line with the rest of the country.

    Our researched showed that of the 48 states that allow semi-auto rifles for some type of hunting whether is was for predators, elk moose deer antelope, bear and whatever small game hunting.

    We found that 17 states had some capacity restrictions for hunting, out of that 10 only had 5 round limitation as proposed in Rep Saccone’s legislations plus NJ so you can see PA is not the normal, and the above reason is WHY you will see the anti-gunners come out in opposition to this bill passing into law as it will make it tougher to ban all of your semi-auto rifles at some future point in PA when they have the votes.

    Let’s have a look at all the PA adjoining states to see IF PA is out of line with limiting semi-auto rifles or is PA really such a hunter friendly state

    Before NY SAFE Act passage the limit was 10 rounds
    Now its reduced to 6 rounds because of the so called SAFE Act

    Even New Jersey allows the use of semi-auto rifles for hunting even if they are subject to increasing levels of gun control

    A modern rifle magazine need not be pinned (plugged), but may be loaded with no more than three cartridges. Rife permit holders of all ages may hunt with all rifle types as allowed by New Jersey laws.

    Wow even NJ trusts hunters to be responsible enough and not put more rounds in the gun yet in PA we can trust you to hunt responsibly with a semi-auto firearm.

    Ohio has no magazine capacity limit for semi-auto rifles except for deer - see correction.

    Correction - in 2014 it was legal in OHIO to hunt with Rifles that use some straight wall cases in limited calibers (including semi-auto rifles) for deer, there is no mag capacity for hunting with semi-auto rifles in Ohio for other game - Shotguns and straight-walled cartridge rifles can be loaded with no more than three shells in the chamber and magazine combined read details here

    In case someone is curious the OTHER state that prohibits semi-auto rifles is, Delaware and they don't allow hunting with center fire RIFLE semi, bolt, lever, NOTHING hunting with a center fire rifle

    Except groundhogs, foxes and coyotes may be hunted with a center fire rifle in Delaware

    IF Delaware were ever to legalize semi-auto rim fire rifles for hunting of something that would leave PA the last state to ban any semi-auto rifles.




    Keep in mind for MANY YEARS the PA Game Commission has allowed semi-auto shotguns with rifle slugs (accurate out to 200 yards) for use in these same small wood lot areas for hunting deer and small game with the most dense population areas in the state.

    Apparently hunters using these semi-auto capable firearms are not causing problems in these urban areas and they shouldn’t be anywhere else in PA.

    48 states allow hunters to use semi-auto rifles for hunting without all the drama and claimed problems with slobs hunters.

    ITS NOT the type of GUN that is the PROBLEM its the slob pulling the trigger, works the same with gun control, limiting the use firearms of the good guys, don't do anything about bad guys


    Unless you are saying that PA hunters in general … including you are less responsible with the safe use of firearms than the hunters in the 48 other states are!

    This change shouldn’t be a big problem to make PA the 49 state to legalize hunting with semi auto rifles, not to mention many other countries allow semi-auto rifles for hunting.



    IF you are for this concept of bringing PA firearms choices into the 21st century for hunting purposes.

    Write up a letter to the Reps asking them to co-sponsor Rep Saccone’s HB 366 Hunting with Semiautomatic Rifles in PA legislation.

    Also bug all the members of the house Game & Fish committee as they need to hear from US, that is IF you want this change do your part!

    Have the parties causing obstructions been dealt with? Or is this going to be another "There, we did something", with little regard to whether or not the actual result is getting it enacted?

    What I mean by that is that the problem has been in the past that the path hadn't been cleared, and it seemed like they didn't want to do the work to clear it--stand up to party leadership either keeping it down or putting other stuff ahead of it, hold an extra Game and Fish Committee meeting, etc. We need every call, every letter, and every voice from each and every one of us here. No way around that, never need less at any time ever. I'm just saying if there's something that needs to be lifted with a crane rather than a shovel we need a crane operator to support the work we with shovels do, so we'd better be calling the crane operator(s) not just more guys with shovels.

    We need this to get passed this time, and we need to start on it NOW. Emailing them all today, then probably once a week at least. Talk to local major political contributors, county party people, etc.

    And agreeing with a five round limit would deflate the biggest argument people have against semiautomatics for hunting - the "you don't need no 30 round clipazine to keel a deer wit!" With a five round capacity, we'd actually be UNDER the rounds carried by some other commonly used hunting rifles.

    limit 'hunting magazine capacity' to 5 rounds and I'm on board; I used to live in Tennessee where semi autos are allowed for hunting...nothing tightens your sphincter than hearing a steady string of shots that sound like their getting closer to where you are located! after 5 shots I would lie on the ground until the shooting stopped...sometimes overzealous idiots would try to shoot at deer running away! the thought of 10 rounds in an SKS or 10 or more rounds from an AK or AR being blasted unsafely in the woods is not something I want to deal with again! I know there are other semiauto rifles/carbines that take mags that hold more than 5 rounds...I just used the SKS, AK, and AR as examples...

    back when I owned a Ruger Mini-14 I often pondered how to set it up for hunting...a good quality Bushnell 3-9 power scope, two 5 round mags, and Fusion 62gr bonded softpoint ammo in .223; after hunting season remove the scope & use in open sight defense mode with 20 round mags; nowadays I would just remove the mag plug in my Benelli Nova and use 1 oz foster slugs and limit shots to @ 40 yds using the 2 beads on the barrel rib...

    You're missing the point.
    When I'm hunting by fire only one shot at a deer. If I miss, then the deer gets away. This has nothing to do with needing the extra rounds, I'd single load if I had to. Mainly, I just want to be able to use my favorite rifle.
    Unfortunately though, finding 5 round magazines for the AR 10 is difficult and/or expensive. They also don't stick out of the magazine well, and can sometimes require a tool to remove. 10 rounders are much more manageable.
    Why not limit the amount actually filled into the magazine instead, and not the overall capable capacity?

    I think a 5 round limit is stupid.
    Cyote , ground hog and other varmint hunting would reasonably require more than five rounds.
