    This is a MAJOR change to the UFA, as you shouldn't first have to pay a fee and get permission slip from the government before exercising a Constitutional Right if you want to transport your firearm. No other Constitutional right has such restrictions!

    Allegheny County Sportsmen’s League (ACSL) request for sponsorship letter (with the bill number changed)

    Rep Rick Saccone has introduced Constitutional Carry (HB 230) and is currently seeking co-sponsors for this important legislation.

    Constitutional Carry will create a two-tiered system with the carrying of firearms for lawful purposes:

    • Option 1 gives citizens the ability to obtain a (LTCF) License To Carry Firearm permit that is valid throughout Pennsylvania and would provide for carrying firearms in other states (currently, (32) states either recognize Pennsylvania LTCF’s or there is a reciprocity agreement in effect).

    • Option 2 recognizes that Commonwealth citizens have a fundamental constitutional right to keep and bear arms (Article 1, Section 21) and that ‘no LTCF’ is required for law abiding citizens to carry a firearm throughout Pennsylvania.

    It is a well recognized fact that criminals cannot and do not apply for LTCF permits. The statement (below) by Philadelphia District Attorney Williams underscores that reality:
    • District Attorney R. Seth Williams said the “85% of the homicides in Philadelphia are caused by handguns, with 99% of those being committed by individuals not licensed to carry and after having obtained the handgun illegally.”

    Currently in PA there is no License to Carry a Firearm (LTCF) permit required for law abiding citizens to openly carry a firearm throughout Pennsylvania. This principle acknowledges that Pennsylvanians have a fundamental constitutional right to keep and bear arms (Article 1, Section 21 of the Pennsylvania Constitution)

    If a citizen can pass a criminal background check to purchase a new firearm it is patently unjust to first require obtaining a government issued permission slip before exercising a right and constitutionally questionable to add layers of bureaucratic regulations on those who are least likely to commit a crime just because the citizen prefers to carry his weapon concealed.

    Then when one examines the enforcement of the laws, against criminals, for ‘carrying firearms without a license’ the reasoning behind mandating a license ‘only’ for law abiding citizens quickly falls apart.


    The enactment of this legislation into law will also benefit citizens exercising their ‘right to bear arms’ in a number of areas:

    • Transporting firearms - Currently in Pennsylvania it is a crime to transport a firearm (section 6102 definition) without a license except in four very narrow exceptions in the law unless the individual transporting a firearm has a LTCF permit. Stopping to refuel one’s vehicle or at a restaurant or even to going to a restroom without having a LTCF permit puts the unknowing, law abiding citizen in jeopardy of prosecution for a misdemeanor 1 crime.

    • Limit abuses of law abiding citizens – recent examples of incidents throughout Pennsylvania (ex. Mark Fiorino/Philadelphia) demonstrates that the licensing process and carrying of firearms by law abiding citizens is rife with problems and institutionalized prejudice.

    • Reform the issuance of LTCF permits – a number of urban centers in Pennsylvania have instituted policies and procedures that directly or indirectly conflicts with state law (section 6109). This legislation also clarifies the intent of the law and the legislature regarding these issuance procedures in numerous areas.

    • Removes the exemption for cities of the 1st class and restates the constitutional premise of equal protections.

    Five states currently have Constitutional carry:
    1. Vermont – (In effect for over three decades and the state’ violent crime rate is usually the lowest in the nation)
    2. Alaska 2003
    3. Arizona 2010
    4. Wyoming 2011
    5. Arkansas 2013

    Some of the other states considering constitutional carry are:
    Colorado, Idaho, Iowa, Kentucky, Maine, Montana, Minnesota, Nevada, New Hampshire, South Carolina, Texas, Tennessee, West Virginia, Georgia, Montana, Oregon, Utah, Virginia.

    The political reality is going to be a series of pitched heated battles to get Constitutional Carry passed in law in the 2015-2016 session, so was all pro freedom legislation in the past were also a major endeavor, this will not be an exception.


    As the other side will scream and rant against this concept in many media venues, areas where all of you can post your comments to counter them.

    In HBG we all are going to have to come together to work with numerous legislators to get their support for passage

    So are you up for the challenge to regain your rights lost decades ago when the government converted a right into a privilege when a LTCF permit was required.

    IF you want this passed hoping don't get it done......Get active and contact the Reps


    Freedom is not free

    IF you wish to have the benefits of Constitutional Carry, you are going to have to do some of the work by contacting the Reps, right now for sponsorship phase, hopefully with enough support from gun owners for the required votes in committees and house to get this on the governor’s desk for signature.


    As a side note IF we can get this passed, it will REALLY torque off all of those that celebrated the closing of the so called Florida loophole by PA attorney general Kane along with rewriting several reciprocity agreements

    Why change "Sheriff" to "issuing authority"? I don't see where if identifies this issuing authority.


    Looks like it would also remove restrictions on switchblades?

    Dear sir or Madam (and important staffer),

    I am writing this e-mail today as a politically active voter in the Commonwealth, but also as a Staff Sergeant in the PA ARNG a position which you well soon see is relevant to this correspondence.

    The firearms laws in our Commonwealth are difficult to follow, and can not be found in any one concise location, with wording that is often contradictory in different statues. Because of this, well meaning people can commit crimes without meaning to.

    Such was the case two years ago, when a soldier in my mortar platoon was involved in a traffic accident during a drill weekend with a firearm in his personal car. He did not have a license to carry firearms, believing that as long as the firearm (pistol) remained unloaded in his car he did not need one. This was incorrect, but would have been correct if it was a rifle, or shotgun.

    He would have been facing charges of a misdemeanor of the first degree, at a minimum. Since he was in an accident - if he had been cited for that accident he could have been facing charges of a felony of the third degree as 18 Pa.C.S. § 6106 says this is the penalty if the person carrying the firearm"committed any other criminal violation"

    Thankfully, the accident occurred during a drill weekend, and the investigating police department felt he was protected under 18 Pa.C.S. § 6106 (b) (2): a Members of the army, navy, marine corps, air force or coast guard of the United States or of the National Guard or organized reserves when on duty.

    Had this accident occurred 36 hours earlier, his firearm would have been taken as evidence, he would have been charged with a serious misdemeanor or felony, and likely would have been rapidly discharged from the PAARNG. We would have lost a valuable, experienced soldier who constant preforms his duties above the level of proficiency. Worse, he would have been charged under a criminal statue that violates the Constitution of the Commonwealth of Pennsylvania which he swore to protect, well believed he was complying with the law.

    § 21. Right to bear arms.
    The right of the citizens to bear arms in defense of
    themselves and the State shall not be questioned.

    It does not say: except when in, on, or around a vehicle. Shall not be questioned sets an astonishingly high bar. It does not say "if a person is in their home" or "fixed place of business" a term I find especially concerning since in my adult life I've only had one job where I worked in a "fixed place" I submit to you that the Constitution is very clear that any Citizen of the Commonwealth has the right to carry a firearm as enumerated in our Constitution and urge you to bring the law in line with our Constitution

    Feb 10, 2015 South Dakota Constitutional Carry Bill Passes House, Heading to Senate HB 1116 passes in the South Dakota House of Representatives by a vote of 44 to 23.

    South Dakota just took a step toward abolishing its pistol permitting system:

    PIERRE – A legislative panel has approved a proposal that would allow people in South Dakota to carry a concealed pistol without a permit.

    The House State Affairs Committee on Monday narrowly voted to pass the measure, which removes the requirement for a concealed pistol permit from state law.

    Openly carrying a firearm in South Dakota is legal. Republican Rep. Jim Stalzer of Sioux Falls told the committee that he has a concealed pistol permit and has been in situations where he’s been glad to have it.


    If the measure becomes law, South Dakota would join Alaska, Arizona, Arkansas, and Wyoming as a constitutional carry state. Similar measures are being considered — or have been considered — in 21 states. Four states have abolished carry permits in some circumstances

    Dear Sir/Madam, indispensable staffer,

    I am writing this e-mail today as a politically active voter in the Commonwealth.

    Being a licensed motor vehicle safety and emissions inspector of our proud state I understand that there are areas of our law which can be perilous when unclear. The inspection station that I manage operated on a basis of long-standing practice and kept immaculate records of its activity. Recently, however, the agency governing our emissions program issued a large fine and shut our station down for a reduced sentence of 1 year. Shortly afterward a state-wide memorandum was issued to clear up the murky regulations surrounding our situation. A bit late, to be sure!

    When reviewing HB 230 I can only imagine how much worse it would be for a long-time firearm owner to be dealt the equivalent penalty for failing to understand the murky legislation surrounding carrying firearms. My station is out of commission for a year and may survive to tell the tale, however a firearm owner may never recover to own a firearm again! The character of the firearm owner, despite safe practice in accordance with our constitution and without causing any harm, will be marred permanently and the poor person may even be incarcerated for his understandable actions.

    I firmly believe that the current, abstruse and over-reaching legislation not only muddies the waters surrounding legally carrying a firearm but grossly infringes on the wonderful and necessary innate right protected by our beloved constitution as Americans.

    Truly, we as Americans are blessed in many ways. One way we’re exceptionally fortunate is due to the protections afforded us by our constitution. Another is our practice of electing our leadership to represent our interests. I’m a happy, proud American and Pennsylvanian to have the wonderful representation that I have in you, and trust that you’ll hear my will. Lord willing, you’ll proceed with my and likeminded individual’s wishes in mind.

    This will never fly with our new governor. I see a lot of crap stalled out for the next 4 years. As a matter of fact, Wolf is so closely aligned with Obama that it isn't a stretch to think he will start acting as unconstitutional as our current dictator/impostor in chief.
