It's all going to depend on whether the judge (or judges) is/are more interested in reading the law, or in advancing their agenda. IMHO, it's astonishing that we have NOT had such a case until now. It should be obvious that anything for which a license is required is not (virtually by definition) a right. And yet the Constitution says that the keeping and bearing of arms IS a right. Since Florida's legislature has seen fit to decide that a license is required to carry concealed, then obviously that mode of carry is not a right. Ergo, the available mode for everyone to exercise their RKBA has to be open carry.
It's really quite simple, and a couple of states have already ruled along these lines (Ohio and, I think, Idaho).

Many of the sheriff and police departments do not support the open carry by citizens in FL. They like to be the only one that can strut around showing their firearms. Especially in eating establishments to show they are cops.
