    Yes Sir. Especially when Kennedy is actually a Justice who is 50/50 on Left/Right leaning subject matter. The rest tend to lean towards their respective ends of the political spectrum.

    It was unlikely to succeed even when Scalia was alive, even with arguments other than the inane "I can possess this new MG because my trust isn't a person" theory. It jumped several necessary steps, we barely had "the 2nd is an individual right" from Heller, and "the 2nd is incorporated to the States" from McDonald. Notice that the decision doesn't even pretend to apply "strict scrutiny" to this individual right; we needed another couple of Gura wins before we could get to nullifying the 1986 freeze.

    The Heller decision included the seeds of the death of this case, but the players refused to notice. The "dangerous and unusual" guns were carved out in Heller, so there was zero chance that Heller supported new MG's for everyone.

    I would have liked $800 transferable M16's. Not gonna happen now. They tried for a bridge too far, too soon, saddled with a stupid "trust" premise that any 1-L could have shot down. We should leave these things to Gura, because he knows what he's doing and he wins the incremental war.

    That this is a free country? Oh...and California repealed their AWB and magazine limitations, while going "shall issue."
