Defense attorney Alan Goldberg filed a motion that the traffic stop was unconstitutional and subsequent seizure of drugs was illegal.
Cullen agreed in his recent opinion and order. The charge was dropped last week.
Cullen wrote that Jackson was stopped along the turnpike in Bowmansville for well over an hour. Hope continued to ask investigative questions even after the stop was over, Cullen wrote.Rules are written in the stone,

That was one of the caveats that was referenced in the LOOOOONG article I posted. The courts who are not opposed to questions outside the original scope of the stop all seemed to qualify that position with the limitation that the additional questioning not extend the original investigation.

IF.. the trooper told him he was free to go and returned his stuff before he started to ask all of the questions, the issue will be the time of the detention before the K9 sniff. I would think they will appeal the dismissal and argue they had RAS. The question then will be can they articulate that an hour long wait for a drug dog was reasonable given the circumstances.
If the trooper didn't return his things first, then Lopez would apply and the questions would need to be suppressed.

Didn't anyone know this was really a seminar on how to act if you were black? It was not set up for everyone. The presenter actually said to announce the fact that you had a LTCF and were armed.
I suppose it wasn't PC to announce it was for blacks. But being sponsored by the NAACP might have been a clue.
Would have been better to have an attorney present this info. Maybe POFOA
should get on this someday?
