record expunged

I have a question about having my record expunged but do not know were to post it. I had two DUIs 40 years ago, and have not drank since. The DUIs was when I had just turned 21 and I was in the Air Force. If you could let me know were to start, thank you.

It sounds like you were convicted, so I'm pretty sure you'd need a pardon before you could apply for expungement. Probably not a difficult process in your case. [This differs from those who successfully complete ARD, since there is no conviction on their record.]

Two questions...... Why do you want your record expunged? Are DUI's prohibiting????? I was under the impression that it took more than two convictions to prohibit ownership.

Sometimes yes, other times no.


It depends on how they are graded.
Not all DUIs are created equal.

If he's been pardoned, there is no need for an expungement.

While pardons eliminate the penalties of the offense, only an expungement removes the it from your record.

Even if you get a pardon for an offense that would make you prohibited, you would still need an expungement to keep the record of arrest and conviction from holding things up.

DUI's come in different grades, and from different laws over the years.

A single DUI can be prohibiting across the entire USA if the max possible sentence exceeds 2 years. It just depends on what happened(injuries or property damage, etc).

3 normally non-prohibiting DUI's within 5 years will prohibit transfers to you in PA. However you can still own a gun.

DUI's from (2) generations of DUI laws ago(mid-70's and prior) were prohibiting without any special circumstances.

Some state's carry permits heavily factor in DUI's. (Utah for one)

one dui was in Delaware in 1972 and the air force put me on probation for six months and I lost a stripe, the second was in PA in 1977 and I was never charged until 1984, I asked the DA about the seven years and he told me to plead guilty and I would have to pay a small fine. three months later I lost my license for a year, I contacted the DA and told him he lied to me and he said he had no control what the state does. I can't tell you how mad I was. I am trying to get a licence to carry so I can protect my family
