    Default I was assaulted. Advice needed

    I was physically assaulted by my neighbor. I am going to the court house to file for a PFA however I would also prefer to get a concealed carry permit to kill two birds with one stone. Will the courthouse officials deny me based on being a victim of assault with an active PFA against my neighbor?

    You can't swear out a "Protection From Abuse" order without being in a relationship with the person you're trying to get protection from.

    Well according to the police officer I talked with he said a restraining order would not be what I was looking for and he recommended I get a PFA.

    Pennsylvania doesn't have restraining orders as such. And PFAs are only for people in intimate relationships. I don't think what you're looking for exists in PA.

    So you can rightfully stalk and punch your neightbors in the face in the state of PA? After previously informing law inforcement of the neighbors ill intentions before it even happened? I guess this country is far more fucked than I thought

    Unless laws have changed since I retired, a PFA is a protection from abuse which can be filed if you are in some type of relationship (spouse, family member, significant other) and that person assaults or abuses you. Then you can receive protection as per the order issued.

    There were no types of restraining orders that I was aware of. If you are not in a relationship with the person who assaulted you, you can file charges and upon arrest and arraignment of the person, the judge may make it a condition of bail that that person stays away from you. But you need to file the charges and have the person arrested to get the condition of bail.

    To answer your question. No, being a victim of an assault should not be a prohibiting factor in getting your LTCF.

    The sheriff may be made aware of that record when he does the background check on you, but it shouldn't be prohibiting, if he were to use it, he'd have to give a legal reason why.

    Okay thanks, that's what I was thinking. I will go to the court house tomorrow to see what type of arrangements can be made. On a side note, it sounds like you guys have been watching a little too much Jerry Springer, the police officer was the one who recommended I file for a PFA. I'll let you know what becomes of the situation.
