Re: Murder Charge Over Car Break-In
Yeah, he messed up shooting the thief in the back of the head and in the back.
I saw that story on the news, and knew it wasn't going to turn out good for the guy.
On the other hand, there's one less thug stealing cars. (only sort of joking. Stealing horses used to be a capital offense - a truck might be a modern day equivalent)

Andwhat should we do with this story? Oh I get it, don't shot anyone in the back of the head. I wonder if the guy was on theground when the shooting took place? More info please, not really.

Re: Murder Charge Over Car Break-In
Theres a huge difference between defending yourself and murder. This guy probably had a few options that did not involve taking a life.
If the report is accurate and he shot the thief in the back and the back of the head, and if the woman beating accusations are true, he is a violent scumbag that deserves to be behind bars.
The statement, "Play stupid games, win stupid prizes" applies to both men.

Re: Murder Charge Over Car Break-In
Not the best as far as details. The article seems to paint a picture that car owner was not in the car and came upon someone trying to break in, back toward him.
While you are allowed to defend yourself anywhere you are legally allowed to be. There still has to be a reasonable belief that without the sue of deadly force you will be subject to death, serious bodily injury, kidnapping, or rape. Also when not in your house or car the attacker must have a firearm or other deadly weapon.
Disparity of force is not specifically mentioned in the legislation and the way it is written is all deadly force is illegal except for certain parameters.
When someone breaks into your house you can presume they are there for one of those four things and use deadly force. You cannot make that assumption when someone is just trying to steal your car or its contents.Last edited by QuackXP; August 28th, 2014 at 11:52 AM.

In Texas, the shooter would be good to go.
But not here.
Peering at my old cloudy cracked crystal balls, I see bad stuff happening to the shooter.American by BIRTH, Infidel by CHOICE

Re: Murder Charge Over Car Break-In
AFAIC he's only a murderer if his car was not in the process of being stolen or broken in.

Re: Murder Charge Over Car Break-In
The proper thing to do in this case is walk around to the passenger door, while the guy is trying to break into the driver's side, and unlock the door, sit down and then, only then, shoot the guy. No reason to say anything or confront the guy, just get in the car and do what you need to do to the "car jacker"
