I'm saying it's a nonsensical add-on charge, probably most often used solely as a bargaining chip.
I bet you'd be hard pressed to find an instance where a LEO who overstepped had the same charge slapped on them in addition to the primary charges, though given the language of the statute, it would clearly apply to them as well, whenever they were also committing a crime.
IMO, this is one of those charges that is far more likely to be overused/abused than to deter or increase a penalty in any meaningful way.Get your "Guns Save Lives" stickers today! PM for more info.
