    Default Playwicki Park signs ban carrying...

    Noticed it yesterday when I was fishing there with my son. Playwicki is a county park in Langhorne and I assume that this sign has just not been updated since the ban on carrying in county parks was supposedly rescinded 3 years ago. Anyone else see similar signs in Bucks Co parks? I figure if an effort is made to fix one it might be worth trying to fix others at the same time.

    Local gun laws now preempt State gun laws according to a footnote written by a judge in the Erie case.

    Huh? I thought that ruling solidified that no municipality can preempt state law. Did I read that wrong?

    Edit: nevermind, I did some reading and I see what you're getting at. I wouldn't say that the footnote on its own gave municipalities free reign to preempt state gun laws but rather suggested that they may be able to achieve similar goals by other methods, i.e. charging someone carrying with trespass if they refuse to leave. Looks like a letter to Bucks Co Parks and Rec might be in order...

    In Chester County the solicitor believes the County owns the parks and therefore private property. Statists will do whatever it takes to skirt, shift, obscure and manipulate words to fit their own agendas.

    Wasn't that the argument in Falls Twp as well? Regardless, Bucks County decided 3 yrs ago to drop their illegal ban on carrying in parks and Playwicki is a county park.

    The Chester County Solicitor knows they are breaking the law but they will have you arrested and make you spend all your hard earned money to defend yourself. Hence the strategy of using unlawful misconduct to defend their position. They have nothing to lose because they use your time, your money and your potential incarceration as a deterrent for you to carry a firearm in the publicly owned parks even though the law is on the books that the laws they made and enforced are preempted by State Law.

    Corruption for the sake of an agenda is an ongoing problem and a detriment to a civilized society.

    About 5 years ago or so we had an open carry picnic at a park in Hazle Township. IIRC the threat was that we could be cited. Even the local news crews showed up hoping for something juicy.

    I suspect the township thought differently when we had about 100 people there, men, women, and children.

    I don't see any difference between a county park and a township park.

    I recently stopped in traffic and read a Bucks County Park signed tacked to a tree. Said no hunting, didn't notice anything about a general prohibition of firearms. I'll look again tomorrow night. (Core Creek system).

    If a Chester county solicitor is knowingly advising Chester County to prosecute illegally, it might (fat chance) constitute malicious prosecution and therefor should in an ideal world be actionable. Problem is, as our lawyer Phil pointed out, that ruling in Erie was not exactly panacea.

    Solicitors are kind of insulated from the frey. They are in the grey area of simply giving a legal opinion, are being paid by the entity they represent, and of course will tell them what they want to hear if it is safe (for the solicitor) to do so. If their opinion is incorrect from a legal standpoint, it's an "I'm sorry...thought I was right".

    In a way, governments can gain insulation from suites by having and conferring with a solicitor... another mirror to reflect the smoke.
