purchasing a rifle after ARD
I was charged with Retail Theft, on October 2013, I plead guilty and chose the ARD route. On November 2013 I was accepted into the ARD at the Monroe County Courthouse. My ARD consisted of a 6 month that was completed on April 16, 2014 and fines up to $850. I am in the process of getting my charges expunged and I was wondering If I can buy a rifle. My charges aren't expunged yet, but should take up to a month to be expunged. I wanted to know if i can buy a rifle with this charge still on my record.

If you truly was given the ARD program, and you successfully completed it - you shouldn't have any legal prohibition on purchasing a rifle or shotgun.
HOWEVER, it doesn't mean you wont be red-flagged by NICS or PICS, and you may get denied - which you would then have to file a challenge.

Was it your first time getting caught for retail theft and was the dollar amount less than $150? If so it was just a summary offense and you would be able to buy a rifle even if you didn't do ARD. I would however advise you to make damn sure all of your ducks are in a row before you try to purchase. Just in case.

Just another piece of advice. I have a friend going through something similar. His record was supposed to be expunged too but never was. He was about to go and buy a rifle but I told him to make sure it was. Well turns out someone never filed the paperwork right and it was still there. Now he has to wait a few months for it to go through.

If he knows he is a prohibited person then he is committing a felony, and getting caught with a firearm is bad shit. don't buy anything until you're sure you are legal.
