    Question PA Firearms Preemption Law (Sec 6120) Question

    From what I'm reading. I'm trying to understand it more.

    Does this mean that a town, city, borough, etc. cannot restrict sales of firearms and ammunition? And, if they do, they're violating this?

    You are correct, but there is currently no penalty to violation, so a lawsuit will be the only likely recourse to an preemption violation.

    Mostly, they will try to play hardball with respect to zoning approvals. But if the location is zoned for retail, they shouldn't be able to deny a gun shop if they would approve a hardware store.

    The gun shop is already approved and has been in business for years. But, the township won't allow them to sell to citizens. Only LEO, Government employees, etc..

    I'd want to see what conditions might have been attached to any approvals. The main justification would have to be the difference in traffic volume between the limited govt customers and the entire world.
