Carrying on Bus NOT transporting students...
I feel like I should know the answer to this. Unfortunately, I'm not certain. Here it is...
Is it legal to carry on a "School Bus", not owned by a district, not transporting students, that has been contracted out?
A State Trooper at the LGS said "good to go". We all know the 2 worst places to find legal advice are LEO's (in general, not always) and the LGS. So now you understand my skepticism.
Just to be clear, i did not answer the question, as i was unsure and it wasn't directed at me. Just a B.S. session over coffee at the LGS.Proud to be a Longwall pig...

i would imagine as long as the bus is not being used for school activites...and is contracted for other purposes...you are good to go unless the company says otherwise

Here's the statute:
(b) Offense defined.--A person commits a misdemeanor of the first degree if he possesses a weapon in the buildings of, on the grounds of, or in any conveyance providing transportation to or from any elementary or secondary publicly-funded educational institution, any elementary or secondary private school licensed by the Department of Education or any elementary or secondary parochial school.

Re: Carrying on Bus NOT transporting students...
So if I read this right as long as your not going to or from a school you should be fine. Correct?

Many private companies own "school" buses and use them predominantly to transport school kids to and from school, or on school functions. When not used for school purposes, the private company can use its property however it desires. On a weekend if it wants to use it for charter service, it can. As long as it's not being used for school purposes, I fail to see what the problem is.

If it isn't being used for a school event - you're good to go..
Bus companies regularly do some side-work, like charters, tours, etc.. So long as the chartered service isn't for a school activity it shouldn't be a problem.
I have a friend who's family charters a school bus a couple times a year to shuttle them to all the bars between DuBois and Brookville.RIP: SFN, 1861, twoeggsup, Lambo, jamesjo, JayBell, 32 Magnum, Pro2A, mrwildroot, dregan, Frenchy, Fragger, ungawa, Mtn Jack, Grapeshot, R.W.J., PennsyPlinker, Statkowski, Deanimator, roland, aubie515

Re: Carrying on Bus NOT transporting students...
In our case in Montgomery County, we argued that the VoTech school didn't fall within the K-12 definition of "school", because it admitted adult students (such as our 40-something client, and others in their 20's & 30's).
The judge declined to accept that argument, primarily because the school district owned & operated the VoTech school. (We of course won the case anyway with a complete acquittal, but didn't prevail on that preliminary issue.)
Based on that logic, a "school bus" owned by the school district would be a potential risk. A big bus with the words "SCHOOL STUDENTS" on the side, but owned by a vehicle rental company, being used to transport adults to something like a casino or a picnic on a weekend, would be less of a risk.
It's a gray area. Well, more of a big yellowy-orangish gray area.Attorney Phil Kline, AKA gunlawyer001@gmail.com
