    It looks to me like the gun was visible.

    "A Flint Township man has filed a lawsuit on claims he had to spend Christmas in jail when he was stopped by police while legally openly carrying his pistol."

    Seems to me that he admitted his coat was covering the firearm. If it wasn't for that I don't see how they could have proved different. Just because one cop driving by on a dark, snowy evening didn't see the gun in the split second he passed the guy doesn't mean anything.

    It looked clearly visible to me. Sounds like the cop had a bug up his ass that day and was looking for a reason to stop the guy.

    My question is why did the police officer feel the need to stop the guy in the firat place ? Did he match the description of someone that had just committed a crime ?

    Pretty sure the top half of the gun could have easily been covered, judging by the length of his coat. Raising the hands would have uncovered it.

    Exactly.

    Whats their excuse for stopping the guy if it wasnt for the visible firearm?

    So multiple officers can not properly maintain of troubleshooting a key & common piece of equipment. Which shows they have not been properly trained.

    Also; the officer could clearly see the firearm; when he approached that side - which is what is required. He lifted his arms to ensure it was visible.

    Where's the video of the first pass by the LEO? Why did he turn around and come back if he could not see the firearm the first time?

    How did the officer see it in the first place if it was concealed? It seems he has an axe to grind against legal, open carry. That is why it is smart to get the CPL, as it is called in MI.

    This is why I don't OC in PA, as I do not want to attract an officer that either doesn't know the law, or has something against legal OC. They can bring you in, then it is up to you to spend $$$ to fight it.

    I applaud those that have the guts to OC in populated areas. I don't.

    Edit: I just re-read the outcome, and it seems the let the guy go after two nights in jail, with no charges filed, and he, and his attorney are now pursuing damages. Good for him.

    It doesn't matter what the guy said when the LEO confronted him. The video clearly shows the weapon is being openly carried. That is all that matters.
