So, if this is the case, why is there allowed to be a permit process in the first place?

Because the courts have also determined that carry can be regulated as long as it doesn't constitute an de facto ban. For example, open carry can be banned as long as concealed carry isn't, as you're still allowing carry in some form. Furthermore, the government can require a permit to conceal carry in the interests of public safety, as long as the right of the individual is protected. Sand Diego's "may issue" licensing scheme was arbitrary and capricious, and the standards for issuance were not codified other than to say one must "show need".
FWIW, I believe there's already a case being filed in NJ and sponsored by the NJRPC, SAF, and supposedly to be argued by Alan Gura, the man who argued Heller and McDonald to the SCotUS (I don't recall the name of the appellant). Given this, the 9th Circuit ruling couldn't come at a better time. It will force the hand of the NJ courts, because if they choose not to rule in opposition, it will setup this issue to be heard by the SCotUS, which so far has been relatively friendly on this issue."Political Correctness is just tyranny with manners"

No its not April yet....
But don't get too happy about this one just yet. As my fading memory recalls on the 9th Circuit there is the appeal panel and the full 7-9 judge panel. The group that heard this more than likely the appellate panel.
The state can appeal this to the full court, and if they then agree with the appellate panel then it goes to SCOTUS.
So don't break out the party favors just yet folks.
It ain't over til the fat socialist croaksgotta love her ;)
