    Default Is this considered a straw purchase???

    I was at an auction house yesterday and saw some activity that has to be illegal. There were a bunch of Amish there purchasing firearms but only a few had picture id's. when they were doing the paper work for pics, they were using each others pic identification to do the paperwork and I saw at least 3 different Amish guys using one pic card. The owner of the auction house who is Amish himself said it didn't matter as long as they have the info. Is this illegal and wouldn't it be considered straw purchases??

    Maybe it was the Amish Mafia from tv.




    It sounds like a whole wagon load of straw to me.

    There is no such crime as a straw purchase but the term is typically used to describe an actual crime (lying in the 4473) and not being truthful as stating "you" are the intended and actual buyer

    Sounds like a visit from the BATFE is in order

    On its face, it definitely looks illegal, but heres a thought.

    What about community property? Say the gun is to be used for hunting by 4-5 people, all with an equal share in it, much like alot of Amish farm equipment. none of them are prohibited persons. only ONE can fill out the paperwork, and there can be ONLY ONE approval number for each firearm. In that case, i wonder what the law says.

    Law says the transferee needs to be the person filling out the paperwork

    Law also says that a firearm can't be given or transferred to someone else unless they use an FFL or have a LTCF for temp loan

    The Amish buy guns? Hmmm, from the movie "Witness" they made it seem the Amish thought all guns were bad.

    Perhaps if they were handguns, but the OP didn't say.

    No they weren't hand guns. The one guy didn't have a pic ID and the auctioneer wanted to do the sale so he got one of the other amish guys id to do the paperwork and in the process of that happening another amish guy had the same problem so the auctioneer said "just use this ID card, I'ts Ok as long as we have someones info on the sheet, It doesn't matter".

    I thought they couldn't have pictures taken of them for religious reasons?

    If they are all brothers / father & son, I don't know that transfers are required on long guns. I personally know of amish/ Mennonite families with 12+ kids.
