Transporting Firearm to NJ
Hi guys, I am asking this question for a friend's father. My friend's father lives in PA, has a license to carry, and owns a J-Frame S&W. He also owns a house down the shore in NJ. As long as he:
a) transports his firearm seperated from his ammo (gun in the suit case in the trunk and FMJ rounds in the glove box),
b) drives straight from his house in PA right to his shore house in NJ, and
C) only keeps his gun at his shore house while in NJ
Is everything okay (meaning is this legal)? I didn't know if he would have to apply for a NJ firearms owners ID card and/or for a permit (not LTCF) for this revolver too?

In general handgun possession is prohibited by NJS 2C:39-5b
NJ DOES NOT provide an exemption for the transport of firearms between differing residences except while moving.
FOPA transport protection does not apply in your scenario.
An NJFID would not allow for the transport of handguns - only longarms.
The ONLY way to transport handguns is with an NJCCW or qualifying for an exemption under NJS 2C:39-6.Last edited by tl_3237; December 14th, 2013 at 05:06 PM.

What if he was moving to NJ? Does have to surrender his handgun to the state for good?

If he is moving his abode to NJ he simply transports the firearms during his move of household goods directly to the new home. No requirement to register (except machine guns and assault firearms) or otherwise notify authorities. Of course all firearms imported into NJ must be NJ legal. Would recommend a new resident at least obtain the NJFID card to allow for the in-state purchase of handgun ammo. No large capacity mags > 15 rounds for semi-autos except for registered assault weapons.

e.Nothing in subsections b., c. and d. of N.J.S.2C:39-5 shall be construed to prevent a person keeping or carrying about his place of business, residence, premises or other land owned or possessed by him, any firearm, or from carrying the same, in the manner specified in subsection g. of this section, from any place of purchase to his residence or place of business, between his dwelling and his place of business, between one place of business or residence and another when moving, or between his dwelling or place of business and place where such firearms are repaired, for the purpose of repair. For the purposes of this section, a place of business shall be deemed to be a fixed location.
Depends on what the definition of "moving" would be and whether he owns the property.

Even if it were legal, I don't think a glove box is far enough away from the occupants of the vehicle. Both guns and ammo need to be in the trunk in separate containers. At least that is my understanding of the laws.

The firearm should not be directly accessible from the passenger compartment of the vehicle. If the vehicle does not have a compartment separate from the passenger compartment, the firearm and ammunition must be in a locked container other than the vehicle's glove compartment or console.

NJ statutes specify the transport mode while within the state:
NJS 2C:39-6g. All weapons being transported under paragraph (2) of subsection b., subsection e., or paragraph (1) or (3) of subsection f. of this section shall be carried unloaded and contained in a closed and fastened case, gunbox, securely tied package, or locked in the trunk of the automobile in which it is being transported, and in the course of travel shall include only such deviations as are reasonably necessary under the circumstances.IANAL
