    Default Transfer from Ny to Pa

    I need help with this. My brother has my .22 rifle register in his name in NY. It is my gun but he registered it when i was young. Now that I am older I want to get it back. What do I need to get the gun from him. I live in PA. Any suggestions.

    It depends on how the law believes who the true owner is..

    If you are the true owner - you can retrieve it or he can bring it to you.

    If he is the true owner - then it needs to be delivered to a FFL so that a proper transfer is recorded. (because of interstate issues)

    The legally safest way is for him to deliver/ship it to a FFL and you do a federal 4473 transfer.

    Now, some FFL require a gun to be shipped from another FFL - so that may involve (2) FFL's. But legally only one is required on the receiving party's end.

    NY law really doesn't regulate private long gun transfers outside of NYC unless they are "assault weapons". Although, the new "Safe Act" may have changed that. So, I recommend him shipping/delivering it to a FFL to do a proper transfer.

    How is it that he needed to register a rifle in NYS (outside of NYC)? The Safe Act pertains to assault style rifles, and having to register those types of rifles.

    Some folks refer to the federal 4473 as a "registry" not knowing it is just a dealer kept record of the transfer.
