    Default Out of state transfer of NFA Firearm

    Hi guys,

    I have had some interest in my AR15A2 Sporter II w/ RDIAS. Can somebody point me to a link or such that will explain how an out-of-state transfer can occur? Are there TWO transfers that have to happen, i.e., one to the FFL and one to the individual? Am I only involved in the former?

    Any help would be appreciated.

    If the RDIAS is out of state what will happen is this:

    If the current owner is an SOT he will transfer it tax-free using an ATF Form 3 to your SOT/Dealer in PA.
    If the current owner is an individual he will transfer it with a $200 tax using an ATF Form 4 to your SOT/Dealer in PA.

    Once your dealer has received the RDIAS he will transfer it to you with a $200 tax using an ATF Form 4.

    In that case (I am assuming you are not an SOT) you will need to submit a Form 4 with a $200 tax to transfer the RDIAS to an SOT in the buyer's state. At that point that SOT will beed to submit another Form 4 with a $200 tax to transfer it to the actual buyer.

    Thanks much. I have been involved in a lot of interstate firearms sales, but haven't been involved in an NFA transfer since 1985.
