    HB 921 PICS elimination – saving Freedom, taxpayer monies & reducing size of government

    Fellow Gun owners, we need your help,

    We have a limited window of opportunity, in the remaining fall session, to advance ‘Critical Pro-Gun legislation’, HB 921, that would eliminate the PA State Police (PSP) run ‘firearms background check system’ (PICS) in favor of using the (federal) (NICS) National Instant Check System. This would remove unnecessary duplication of systems (leading to ‘more’ downtime of Instant Checks) as well as the extra layers of state bureaucracy of the PA State Police (PSP). It would also ‘eliminate’ YOU & I being forced to PAY to exercise our Constitutional ‘Right to Bear Arms’ because NICS does NOT charge fees to buy a firearm like the PA Instant Check system (PICS) does!

    In addition, PICS ‘errors’ are distressingly common. These errors arise from a myriad of reasons. Two names can be identical, social security numbers can be transposed, very old court records can be wrong, or the sentence for a crime that was not punishable by more than a year in jail when it was committed can be later amended.

    Furthermore, if a court record or PSP report is incomplete or ambiguous, authorities (PSP) in Pennsylvania presume the worst, and leave it to YOU, the individual, to prove yourself innocent!

    Perhaps the most worrisome aspect of the PICS system is the position taken by the PA State Police that ‘if’ the system becomes inoperable (OR they don’t answer the phone) then ALL FFL firearms transfers cease. In other words a constitutional freedom is at the mercy of a machine with ‘no’ backup protocols or bypass regulations established and ready to implement to fulfill and safeguard the most important role of government, which is to protect individual freedoms. This means, in essence, that the 2nd amendment and Article 1, Section 21 will cease to exist in the event of mechanical or electronic failure. This ‘should’ concern all of us!

    Most importantly it is outrageous that we should have to pay a fee to exercise our constitutional rights, to PSP to run a background check, and after paying extra cost PA gets poorer service than NICS provides to run the federal required background check. Maybe that’s why PA is one of only thirteen remaining, full POC, states that still use the state Point Of Contact option and eight remaining ‘partial’ POC states (‘only’ for concealed carry licenses).

    It’s time to show Harrisburg AND the Bloomberg supported ‘anti-gun’ groups, once again, that ‘WE’ care about our constitution and our freedoms!

    If you have not been paying attention gun owners that had excessive gun control in bordering states like New York, New Jersey, Maryland, Delaware have all gotten more gun control in 2013, mostly because of gun owners not being pro active in the defense of their firearm rights, prior to the attack.

    In the next election cycle all the money normally spent to elected anti-gun politicians to office and money spent on lobbying for gun control in those state adjoining PA can re task ALL of that money and effort in PA to take away you firearm rights.

    Right now all they lack is the votes for passage of more gun control in PA, its sure not for lack of sponsoring legislation. Don’t make the same mistake that gun owners did in those states did and take it for granted that it can’t happen in PA as well.


    The elected politicians in HBG haven’t been hearing from gun owners very much, while the anti-gunners have been constantly beating their drum for enacting more gun control in PA.

    This has frozen any legislative action to make PA more law abiding gun owner friendly, we have the support (right now) to make sure nothing anti-gun moves or governor that would willingly sign more gun control, something that couldn’t be said in the past.

    For the official record NO one has lost an election over being too pro gun, while many have been removed from office with gun owners help because of their anti-gun votes, in direct defiance to article one section 21 oath to support, defend and OBEY the PA constitution.

    HB 921 appears to be the least controversial legislation that would bring direct benefits to PA gun owners and tax payers to PA. If this bill moves nothing says that other pro gun measures couldn’t be amended to HB 921 especially made much easier IF the anti-gunners attempt to load a bunch of anti-gun amendments as they have done in the past session.

    PLEASE READ the attachment and you judge for yourself if the supposed benefits of keeping PICS is worth the cost, in you paying extra cost before exercising a constitutional right. As NICS doesn’t have all the down time and long waiting on hold time that is common with PICS, really what is your time worth, to stand there waiting minutes for something that should take an instant.

    Also keep in mind IF the other side get the ever gets the vote they can raise the PICS transfer fee cost to any amount they can get away with (as they have tried in the past).

    as stated before HB 921 appears to be the least controversial legislation, we can support it or we can get nothing, really IF the legislators are not hearing from gun owners about something, why should they listen to us next time when the other side has the votes

    Very brief history BTW the whole instant check system was created by the feds.

    The permanent provisions of the Brady Bill of 1993 gave the Federal Government 5 years
    to set up the insta-check system. The Federal Insta-Check system (NICS) went into effect
    on November 30, 1998. The Pennsylvania Insta-Check System (PICS) went into effect on
    July 1, 1998 for handguns and on November 30, 1998 for all guns.

    On June 13, 1995, Governor Tom Ridge signed Act 17 into law, creating the PICS background check that replaced the former, mandatory five-day waiting period. The Uniform Firearms Act has been amended by Act 66 of 1995, Act 5 and Act 77 of 1996, Act 70 of 1998, and Act 121 of 1998 (with all of the amendments to correct some of the original problems with Act 17 screwing law abiding gun owners over, this its self is a history lesson all should study up on, to see what was lost with Act 17 in 1995).

    Pennsylvania is a "Point of Contact" State. Firearms licensees in Pennsylvania access the
    insta-check system through PICS, which includes a check of the NICS system.

    This attachment is the actual text of HB 921 highlighted in yellow for new text and grey for text to be removed to make it easier to read, for your to understand and judge for yourself is PICS worth the added cost of keeping it to add more state requirement on top of feds requirments.

    For those not use to reading proposed legislation everything in existing law between [ ] is being removed if approved everything unlined is new text.

    you will note the requirement for completing the ROS (Record Of Sale) going to the state police is deleted from the HB 921.

    Nothing in HB 921 is written to deal with the existing PSP illegal ROS of firearm that is decades old (that is a separate issue) please don't confuse the two subjects see text of HB 792 to remove the ROS retention.


    However,

    Without the continual feeding of potential new victims being feed in to the illegal existing PSP record of sale, the existing PSP database will quickly be outdated and even less accurate over time. “The reasons” the PSP was able to win the ACSL lawsuit against the PSP keeping and retaining the existing one will be null and void if HB 921 is pasted into law. This is worth fighting for, due to many abuses already posted on PAFOA about the PSP database (see OP attachment for additional examples)

    Also the UFA will actual decrease in size, a goal we should all strive to complete as almost every law in there, ever page is in direct violation of article one section 21 that questions your rights.

    Article 1 DECLARATION OF RIGHTS Right to Bear Arms Section 21.

    The right of the citizens to bear arms in defense of themselves and the State shall not be questioned.

    Don't overwhelm your Representatives. I sent this. I'm not a perfect scribe, but I can guarantee you that if your Rep can't read an e-mail in 45 seconds, he or she won't. Let's get the bill out of Judiciary first, then go into attack mode.

    I have followed the issue of the Pennsylvania Instant Check System versus the National Instant Check System, and putting aside all of the rhetoric and posturing, one clear fact remains. PICS costs the Commonwealth of Pennsylvania, We the People, nearly 7 million dollars each year. NICS most certainly costs We the People, too, as there is no free lunch, but it is funded from taxpayers across the Republic.

    Frankly, Representative Marsico, I don’t see the value in a 7 million dollar program that is arguably ineffective, or perhaps better said, less effective than NICS. I’m writing to very simply, and respectfully, ask that HB 921 be freed from the Judiciary Committee and sent on to the House for a vote. I feel certain that my legislator, the Hon. Mr. Maher, can find worthwhile uses for the 7 million dollars the Commonwealth doesn’t spend on a program that duplicates one already in place at the Federal level.

    I can not support this. I do not believe there is Constitutional Authority for the NICS system to exist.

    Additionally, we know the FBI routinely, keeps illegal records of NICS checks. The fact of the matter is that Federal Agencies are above the law an answer to no one.

    The PICS system is not perfect. We know PSP keeps a database of pistol buys, despite this being of questionable legality. However, they do not keep a record of long arms. As to the downtime, it crashed for a short time do to massive overload due to panic caused by federal legislation, which included a gun registry... We did not see it, but the federal system was nailed just as hard, and had very length wait times. PSP worked very hard to get it up and running, and seemed generally concerned about the problems it caused. Which is more than I can say for the NICS system.

    PSP is far more answerable to the public than any federal agency. Law enforcement needs to be held accountable by the people they serve.


    Pennsylvania is not Maryland, Their problems, are not our problems, and the horrible background system they have was created to prevent their citizens for exercising their rights. For Maryland, the NICS system would be an improvement. For Pennsylvania it would be a federal intrusion into State's Rights, which well make it far easier to threaten lawful gun owners. If you want to start saving taxpayer money, I'd say the NICS system is a good place to start. Getting rid of the FBI wouldn't be a bad second.


    And at the end of the day, I would take the word of a Pennsylvania State Trooper before I'd accept the word of a federal agent if it was signed in the blood of their first born & sealed with wax made from the fat of angels.

    I got stuck with Frank Farina up in Eynon after Ed Staback retired. Mr. Farina says he's pro gun but when you visit his office he has a news article hanging on a file cabinet stating he wants more gun control. If anyone would like a copy send me a private message and I'll get the article to you. Sucks to be me. Called his office the other day and must say I talked to a staffer there and talk about dumb.

    No way I'd support this. Giving power FROM our state to the Federal government? Not ever. NICS is a one-stop shop for the Feds to halt all firearms purchases whenever they like, with a single note in anyone's file, or a slight change to a law, or a bureaucrat that *accidentally* makes a typo or *accidentally* says no. No way. The IRS was given explicit instructions to delay in any ridiculous way necessary the applications of any political group that might be aligned against the agenda. You want to give up the decision of whether you can or cannot buy a firearm to another Federal agency (or agencies) that could be next in line for a *special email* from the big O or maybe Lois Lerner will get a new job? No way. All to save 7 million dollars? No thanks. If the PICS system costs so much, I'll pay one more dollar for an instant check.

    Correct me if I am wrong but I believe that a PICS check also involves a NICS check. I am not saying I am pro/anti this bill, but it seems like a lot of people are against the bill because they feel eliminating PICS would give the federal government more power... if I understand how PICS works, the feds have that power already, since PICS relies on NICS. So if the feds are abusing NICS to collect information, improperly prevent an otherwise non-prohibited person from purchasing a firearm, etc. they are already able to do this to PA residents even with the state using PICS.
