    Default What would the charge be...

    in a case like this?

    Cliff notes: Guy gets into an argument with an ex gf in a parking lot, she starts beating on his car window, he sticks a revolver in her face and forces her back to her car. He calls the cops to report, they show up and look at the surveillance vid, he gets arrested.

    Not that I'm planning on going out and doing it myself but what would the charge be for threatening someone with a weapon like this?

    If he has OJ simpsons lawyer, probably disorderly conduct. Other than that, hes in a lot of trouble.

    I would think terroristic threats and kidnapping to start but I'm sure there are going to be a lot more that I can't think of. I'm no Lawyer, but I don't think he'll have to ever worry about being able to legally own a gun again.

    I can't vouch for this guy but it would seem that if he called the cops, he's probably not the dangerous criminal type. The kinda stupid type maybe but hey we've all done dumb things at one time or another.

    I was just wondering what kind of charges one might open themselves up to by displaying or threatening someone with a gun inappropriately. I know some will say you should never pull your gun unless you're actually going to use it and some may say not to pull unless the situation warrants it and you would be willing to use it (slight but important difference there), but what could happen if you genuinely thought you were acting within your rights and the law does not agree?

    IMO Simple assault, Reckless endangering, Harassment, Disorderly Conduct. Maybe a few more depends on the Police who is filing the charges. The guy can kiss his ass good by, along with his gun and freedom.

    I see in his future a PFA. By By guns. He very well may end up in Prison.
