Default Expunged Record and Applying for LTCF

Hi guys, i'm new here. I am going to apply to get my LTCF soon and I had a question. I have had my juvenile record expunged a while ago and was wondering if there will be any issues with my application. The reason I am asking is because a little while after my record was expunged I went to purchase an AR. I was denied at first but then challenged it. I even had my own background check done through the state police and it came back clean. After I did that I sent the challenge form in and it was reversed, got my AR and life was good.

I was just hoping I wouldn't have any issues with the LTCF app. like I had when I purchased my AR, even though my record was expunged. I was also curious about what questions would be asked to my references. I just didn't want anyone finding about my record, I would feel embarrassed. Thank you very much guys!

OMG, there are AR's in Solebury? You should be alright. IANAL, but they are not permitted to call your references and especially not to share info that you are applying for an LTCF.

Great, thank you. Yeah there are haha. I'm glad I got it when I did (before the recent shootings). Great investment if you ask me. Fun at the range, home defense and the value increased!

A friend of mine applied for a renewal in Phila. He had an offense which had been expunged. He stated on the app that he had no history. The app was denied based on his falsely stating that he had no record. They found the expungement (?) and did not count that against him but decided that he had lied on the app and used the character clause. He had to appeal and took a lawyer with him. In the end, he stated in writing that he had considered the offense as having never existed due to the expungement and answered accordingly on the app. The decididg official found that he had not "lied" and granted the renewal. Finally, I have to wonder what expungement means. It apparently does not mean erased or obliterated since it can still be found.

That's what I was worried about. I claimed I had no record as well when I purchased my rifle (denied then reversed). I was told by a lawyer that I can say that because with an expunged record it is as if it was never there. I guess one way is to just try and see.

    "Like it was never there."

That's what gets me. Years ago a friend had his driving record expunged, then obtained a certified copy of it a couple months later when it was almost impossible for him to obtain auto insurance. Sure enough, right there in the middle of the almost blank page were the words

"THIS DRIVING RECORD HAS BEEN EXPUNGED."

How nice. Yeah, insurance companies wouldn't touch him, he had to get state insurance for years to put time on the expungement date and make himself look insurable. I'm thinking nothing looks worse than someone paying big money to hide it.

You should get your LTCF, just don't be too surprised if your record that isn't a record somehow means you'll have to clear a few extra hurdles.
While many claim to support the right, precious few support the practice.

Thank you. I'm hoping there won't be hurdles but I will expect them. I was just worried about the questions my references would be asked. Hopefully none eluding to the fact I once had a record. Thanks again.

The red part is not true as far as I know. You are correct in that they are not permitted to tell them you are applying for a LTCF. Why would they ask for references if they aren't permitted to contact them and get a reference from them? While my references have never been contacted I have heard many stories from other in other counties who have have their references contacted.

Have you told your references that your used them as a reference? I would show them proof that your juvenile recorded was expunged and tell them they shouldn't tell anyone that you have a record since you no longer have a record..

No I haven't even applied yet. Just asking the questions beofre I do. I'd rather not have them know I even had a record. I'm wanted to know if they could even ask about that stuff or if it was more like questions about my character and such.
