    Default What happens to pistol?

    I ordered a pistol online from Texas and had it shipped to my local ffl. Pics denied me. I'm in the challenge process now and I am positive it will be cleared up. I was curious though, what happens when a person gets denied in the challenge. Who takes ownership of the gun? I'm sure it happens now and then with so many online purchases these days.

    I would imagine you could ask the ffl to sell it for you. Or you could sell it to the ffl.

    I would hope so. That would suck to see a gun you paid for sitting under glass for sale.

    It will have to be sent back. It is still "new" until the ffl transfers it. You will more than likely be responsible for a restocking fee though. Probably around 15% of the purchase price.

    That's my impression. You really don't own the gun. I assume the gun would have to be sent back to the seller. You will be responsible for shipping {both ways} and whatever else the seller decides or stipulated in the agreement.

    Your probably going to loose 1-2 hundred dollars.

    Maybe if the gun was new. If you bought off a place likegun broker I would say good luck with that.

    Yeah their site says no refunds for any reasons. I was just curious. I don't think it will go that far since I'm 100% positive I have no prohibiting offenses. The denial will be reversed.

    Should a person be completely denied, the FFL could never transfer it to you. You would still have a financial interest in the gun though, but not legal possession.

    You could sell it to the holding FFL, have him consign the gun for sale to another person, or you could give up your financial investment and abandon the property to the FFL.

    I don't think this is accurate. The original seller may decide to not take it back for any reason. The few times I have know this to happen the ffl sold it under consignment for the original purchaser.
    Some people just plain suck.

    I've always understood it to be that the receiving FFL has taken possession of the gun in their bound book. They are the owner at that point as far as the ATF is concerned. It's ultimately their responsibility until the sell or transfer it back to the original dealer.
