    Default Long gun transfer in PA- non resident of PA

    What is the law regarding the sale of a long gun to a NON PA resident? Is it legal to do so without a background check?
    Hypothetically lets say a resident of New York is in PA, and he wants to purchase a rifle from a non dealer. Can the non dealer sell the New York citizen a rifle without a background check?

    Pretty sure Federal law dictates that an FFL has to do a background check on ALL gun sales. Except maybe to other FFLs.

    No, must be sent to FFL in his home state regardless of long gun or handgun.

    Pa resident to Pa resident transfers are legal for long guns.

    This is why at the minimum, checking a DL is a very good idea when doing a FTF deal.

    Now, an out of stater can buy a long gun from a PA FFL, so, in theory you could sell the gun to your FFL and he could sell it to the out of stater with the required check.
    However, with the laws of states being what they are, you will probably have a hard time finding a dealer that wants the hassle.
    If the buyer failed the NICS, then you would have to have a PICS done on yourself to buy back the gun.
    Could turn into a nightmare.
    This would be legit IMO however I am not a lawyer.

    In regards to longarms. In the case of PA seller and out of state buyer. An FFL is required.
    PA seller with PA buyer no check required.

    Long arms may be purchased here if legal in home state. Pistols can be paid for but must ship FFL to FFL.

    What kind of long gun is this?

    If it is long gun that meet's NY's definition of an "assault weapon" - then the buyer is intentionally trying to break the law and you may be an accomplice should an illegal interstate transfer take place.
