    In the near future, I plan to introduce two pieces of legislation that would address the issue of assault weapons and high-capacity ammunition magazines.

    As a legislative body, we have had the opportunity to work on important firearms legislation this past session, such as the recently-passed straw purchasing bill, House Bill 898. In an effort to continue the discussion on common-sense public safety proposals, I believe banning dangerous assault weapons for non-military and non-law enforcement agents should be addressed.

    With the federal Assault Weapons Ban having expired in the fall of 2004, Pennsylvania has been left vulnerable to violence with assault weapons for the last eight years. According to the Rainbow PUSH Coalition, 20% of law enforcement agents killed in the line of duty in the U.S. are killed with assault weapons. Law enforcement organizations across the country supported the federal ban, including but not limited to the Fraternal Order of Police, National Sheriffs’ Association, International Association of Chiefs of Police and Major City Chiefs Association.

    Our country has experienced so many devastating mass shootings over the past several months and years, and the U.S. has one of the highest number of gun-related murders of the world’s developed countries, totaling nearly 10,000 last year. While curbing heinous acts of violence will not be a one-sided solution, I believe we have a responsibility to ensure we explore every option so that no more innocent victims are taken.

    AN ACT


    Amending Title 18 (Crimes and Offenses) of the Pennsylvania Consolidated Statutes, in firearms and other dangerous articles, providing for an offense relating to assault weapons and large capacity magazines.

    The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

    Section 1. Title 18 of the Pennsylvania Consolidated Statutes is amended by adding a section to read:

    § 6105.2. Assault weapons and large capacity magazines.

    (a) Offense defined.--Except as otherwise provided in subsection (b), no person shall possess, manufacture, import, sell or transfer any class 1 assault weapon or large capacity magazine.

    (b) Exceptions.--The provisions of subsection (a) shall not apply to:

    (1) Constables, sheriffs, prison or jail wardens, or their deputies, policemen of this Commonwealth or its political subdivisions or other law enforcement officers.

    (2) Members of the Army, Navy, Marine Corps, Air Force or Coast Guard of the United States or of the National Guard or organized reserves when they are on duty.

    (3) Officers or employees of the United States duly authorized to carry a concealed firearm.

    (c) Grading.--

    (1) Except as otherwise provided in paragraph (2), a person who violates this section commits a misdemeanor of the first degree.

    (2) A second or subsequent offense under this section shall be graded as a felony of the third degree.

    (d) Definitions.--As used in this section, the following words and phrases shall have the meanings given to them in this subsection unless the context clearly indicates otherwise:

    "Class 1 assault weapon." Any of the following:

    (1) A semiautomatic center fire rifle capable of accepting detachable magazines and a pistol grip protruding conspicuously below the weapon's action, a thumbhole stock or folding or telescopic stock; a flash suppressor, grenade launcher or flare launcher; or a forward pistol grip.

    (2) A semiautomatic center fire rifle with overall length of less than 30 inches.

    (3) A semiautomatic center fire rifle with a fixed magazine capable of holding over ten rounds of ammunition.

    (4) A semiautomatic pistol capable of accepting detachable magazines and a threaded barrel; a second handgrip; a capacity to accept a detachable magazine at some location outside the pistol grip; or a shroud attached to, or partially or completely encircling, the barrel allowing the bearer to fire the weapon without burning the bearer's hand, except for a slide enclosing the barrel.

    (5) A semiautomatic pistol with a fixed magazine having the capacity to accept over ten rounds.

    (6) A semiautomatic shotgun having a folding or telescoping stock; a pistol grip protruding conspicuously beneath the action of the weapon, a thumbhole stock or a vertical handgrip.

    (7) A semiautomatic shotgun with the ability to accept detachable magazines.

    (8) A shotgun with a revolving cylinder.

    "Large capacity magazine." Any detachable ammunition feeding device with the capacity to accept more than ten rounds of ammunition. The term does not include any of the following:

    (1) a feeding device that has been permanently altered so that it cannot accommodate more than ten rounds;

    (2) a .22 caliber tube ammunition feeding device; or

    (3) a tubular magazine that is contained in a lever action firearm.
    Section 2. This act shall take effect in 60 days.

    As you can see reading the text this is FAR reaching to include most of the guns owned by many gun owners in PA.

    There are many "tricky" words in this bill to make the implication far reaching to what this will be able to include, when combined with other parts of the UFA.



    BTW we are taking the political fight to HBG on April 23, 2013, maybe you should consider joining US in the effort to make sure this proposed Assault Weapons Ban and ALL the Numerous anti-freedom (gun control) bill never MOVE!

    &

    This one includes now legal to own NFA items in PA and making other title 1 semi-autos firearms in PA classified as "assault weapons" and BANNED from possession in PA

    In the near future, I plan to re-introduce House Bill 2592 of the 2011-2012 Legislative session, which will ban the possession, use, control, sale, transfer, or manufacture of an assault weapon within the Commonwealth of Pennsylvania.

    Since the federal law prohibiting assault weapons lapsed in 2004, many states have considered legislation to ban assault weapons. According to the Law Center to Prevent Gun Violence, seven states have enacted laws banning assault weapons to varying degrees, including California, Connecticut, Hawaii, Maryland, Massachusetts, New Jersey and New York. In addition, other states have implemented partial bans or restrictions through law or regulation.

    Currently, Pennsylvania does not prohibit the sale or transfer of assault weapons. Once a Pennsylvania resident is deemed eligible to purchase a firearm, that individual is permitted to obtain any weapon of their choice, including highly powerful and dangerous assault weapons. My legislation would amend Title 18 (Crimes and Offenses) of the Pennsylvania Consolidated Statutes by creating a new section, §6121.1 (Certain Assault Weapons Prohibited), to prohibit the possession, use, control, sale, transfer, or manufacture of an assault weapon in the Commonwealth. However, this legislation includes exemptions for members of the United States Armed Forces, Reserve components, the National Guard and law enforcement officers who are performing official duties or traveling to or from an authorized place of duty.

    (a) Offense defined.--Except as set forth in subsection (b), a person may not do any of the following:

    (1) Possess, use, control, sell, transfer or manufacture an assault weapon or obtain a license to possess, use, control, sell, transfer or manufacture an assault weapon.

    (2) Obtain a license to do, in this Commonwealth, any of the acts under paragraph (1).

    (b) Exception.--Subsection (a) shall not apply to a member of the armed forces of the United States or a reserve component of the armed forces of the United States, the National Guard or a law enforcement officer while performing official duties or traveling to or from an authorized place of duty if possession of the assault weapon is authorized under applicable statute, regulation or military or law enforcement policy.

    (c) Definition.--As used in this section, the term "assault weapon" means:

    (1) Any selective-fire firearm capable of fully automatic, semiautomatic or burst fire at the option of the user or any of the other following specified semiautomatic firearms:

    (2) A part or combination of parts designed or intended to convert a firearm into an assault weapon, as defined in paragraph (1) or any combination of parts from which an assault weapon, as defined in paragraph (1), may be rapidly assembled if those parts are in possession or under the control of the same person.

    (3) Any semiautomatic firearm not listed in paragraph (1) that meets the following criteria:

    (i) a semiautomatic rifle that has an ability to accept a detachable magazine and has at least two of the following:

    (A) a folding or telescoping stock;

    (B) a pistol grip that protrudes conspicuously beneath the action of the weapon;

    (C) a bayonet mount;

    (D) a flash suppressor or threaded barrel designed to accommodate a flash suppressor; and

    (E) a grenade launcher;


    (ii) a semiautomatic pistol that has an ability to accept a detachable magazine and has at least two of the following:

    (A) an ammunition magazine that attaches to the pistol outside of the pistol grip;

    (B) a threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip or silencer;

    (C) a shroud that is attached to, or partially or completely encircles, the barrel and that permits the shooter to hold the firearm with the nontrigger hand without being burned;

    (D) a manufactured weight of 50 ounces or more when the pistol is unloaded; and

    (E) a semiautomatic version of an automatic firearm; or


    (iii) a semiautomatic shotgun that has at least two of the following:

    (A) a folding or telescoping stock;

    (B) a pistol grip that protrudes conspicuously beneath the action of the weapon;

    (C) a fixed magazine capacity in excess of five rounds; and

    (D) an ability to accept a detachable magazine.

    (4) A part or combination of parts designed or intended to convert a firearm into an assault weapon, as defined in paragraph (3), or any combination of parts from which an assault weapon, as defined in paragraph (3), may be rapidly assembled if those parts are in the possession or under control of the same person.

    The term "assault weapon" does not include any firearm modified to render it permanently inoperable.

    Section 2. This act shall take effect in 60 days.
    Need more reasons to go to HBG for April 23th to speak with the Reps in person?

    We have several pro freedom bill introduced by Pro gun Reps to enhance your rights, and as you can see there are many Reps dedicated to taking them away, all they lack is votes and gun owners indifference.


    The PA anti-gunners are just warming up with these bills

    We are facing political warfare; gun control is on the front burners in HBG, are you ready to deal with this challenge to your freedoms?

    The REAL Assault is on with your firearm rights under article one section 21 and 2nd A are under attack


    There are MANY Reps in both houses and parties willing to stop these efforts, they need to know that you got their backs, they need to hear from you.

    Is it now worth your time to get personally involved, send some letters, contact some Reps FTF, take a day off to go to the PA state house and make a difference on April 23, 2013 and do whatever it takes?

    This crap cannot be passed. It's so far overreaching its unreal. I'm tired of elected officials introducing legislation about a subject they know nothing about. The people of this state won't stand for it.

    Sickening to know that everything I say to my rep will fall on deaf ears, considering he is the main source of this piece of BS.

    Emailed anyway.

    There is another AWB out there in the wild in PA as well.

    This makes it important for me to hammer home once again that HB 357 needs to not only take care of federal regulations, but in state ones as well.
