    Default What gun control laws can be passed at the state level?

    Looks like Cuomo is not waiting for Washington and is instituting all sort of bans. Does the Second Amendment prevent Corbet to ban ARs or limit magazines? Does he even need the legislature? Not that I see him do it but we once had Rendel.

    With the current rulings - the only thing they cannot do is completely prohibit possession of a handgun or long gun WITHIN a home.

    The current SCOTUS rulings can even allow the states to require a permit to just merely own a gun WITHIN your home and require registration, with the only lawful transporting/carrying out of the home to/from a range, hunting, gunsmith, or when you move.

    All you have to do is look at NY State and City law as to what all the federal courts will allow the states to do. Even manually operated long guns are completely regulated in NYC, requiring a permit to have one in your home, and even they have a capacity limit.

    Sounds extreme but "with the only lawful transporting/carrying out of the home to/from a range, hunting, gunsmith, or when you move." is Maryland today! Almost no one there can get a permit to carry either.

    It is interesting how the FEDs will allow the states to restrict 2A but any restriction of 1A is verboten. er... not approved of...

    And Pennsylvania; the only difference I can tell is PA is more relaxed on what a home is. Of course most of us dont think about how restrictive PA is because we have LTCF's, which takes all of those away.

    Was the intention of the thread to focus on PA constitution? I believe the PA constitution makes a much stronger and less ambiguous (ambiguity is in the eye of the beholder) than the US constitution. Would there be a different standard at the state level, with state government?

    Do we have a 2A in the state constitution? As for making life hard, a lot of liberals want ammo become all but unaffordable. They can do that by just taxing it out of existence.

    PA's Constitution has it's own protection, but that has not stopped any court from recognizing a near limitless power to police things.

    I don't agree with any law infringing on the right to bare arms but I think PA is less restrictive than many other states. You can oc with no ltcf and there is no permit or license to own a gun.
    There are other states that are less restrictive than us I will agree.
    Some people just plain suck.

    I never really gave much thought to what may be don on a state level. I was born and raised in PA, lived outside Buffalo NY for a few years, and came back home. The thought that my home state would follow the rest of the sheep is scary to me. I guess it is time for me to put more pressure on my state legislators about state issues.
