Is it legal to posess pepper spray in NY city?

My girlfriend works in NY city and I was wondering if it was legal for her to posess pepper spray. I can't seem to find a straight forward answer anywhere.

I am in NYC all the time for clients etc. My guess would be no.

The next question is, will she carry one anyway or take her chances?

Pepper Spray IS legal in NYC under certain circumstances. First, you must be at least 18 years of age or older to both purchase and carry pepper spray. Second, you must have no history of felony convictions or assaults. Third, the pepper spray MUST be purchased from an authorized dealer, pharmacy, or gun dealer.(I am including a link below that takes you to a website that gives locations that sells Pepper Spray in NYC.) Fourth, when you do buy the pepper spray, you must complete a form with your name, address, birth date, and signature.


Also be aware that you CAN NOT bring pepper spray that was purchased in another state into NYC. Also, you can not give pepper spray to any minor.

Yes, she can carry pepper spray as long as she's over 18, is not a felon or hasn't been convicted of an assault. I copied this from a PDF file at www.handgunlaw.us:

New York: Section 265.25 (14) and (15) The possession of “selfdefense sprays” by persons who are not felons or who have been convicted of an assault, 18 or over for the protection of person or property and its otherwise lawful use is legal. “Selfdefense spray” is defined as “a pocket sized spray device which contains and releases a chemical or organic substance which is intended to produce temporary physical discomfort or disability through being vaporized or otherwise dispensed in the air or any like device containing tear gas, pepper spray or similar disabling agent”. There are certain labeling requirements. Sales require both a seller’s license and the completion by a purchaser of a registration form. New York residents may only purchase defense sprays from licensed Firearms Dealers or licensed Pharmacists in that state. No more than two sprays may be sold at any one time to a single purchaser.

From reading it looks like fox labs and sabre are ok. I carry a descent sized sabre in a vest pocket and a kimber on my reaction side pants pocket. I know nobody knows what it is because I've gotten shit over the pocket knife clipped on my weapons side pocket.

Just keep it concealed to avoid unnecessary questions and issues. If it comes down to the point where life is in danger/you feel threatened just use it.
