    Default Elk County Sheriff's Office Closed

    Pretty much closed until further notice. I guess no NFA signatures or carry permits....

    This presents an interesting question. Now what? There has to be some legal remedy. I've tried researching a bit, but I can find nothing that outlines what to do in this situation where the county Sheriff is not available. I can't imagine that this can just be let go.
    The 2nd amendment is the RESET BUTTON on the constitution.

    I couldn't find this in the PA statutes, but this is on the Bradford County, PA website:

    The coroner serves as Sheriff when the Office of Sheriff is vacant, or when the Sheriff is interested, partial, or prejudiced in a case. The Coroner's Office is a law enforcement office and the coroner is a law enforcement official.

    Interesting... Perhaps someone should call the coroner and inquire about obtaining a LTCF? I'd be willing to bet he doesn't even have the proper paperwork, or that he would know how to do it if he did.

    I would think that the County Commissioners could be sued by the citizens for shutting down a service that's required.

    Yes (16 P.S. § 401). The issue here is that Elk still has a sheriff but the office is temporarily closed. Don't know if this would be a violation but it does raise an interesting dilemna.

    Sherriff Krieg filed a complaint against the Board of Commissioners to address the closure and budget deficit. The hearing is scheduled for Friday, Dec. 14 at 1:30 p.m. in the main courtroom of the Elk County Courthouse and will be handled by an outside judge rather than Judge Masson.

    Till then, I guess we wait and see.
