    Default PA to NJ transfer?

    So my dad has a nice pride of spain double barrel 12 gauge shotgun that my uncle wants. My dad lives in PA and my uncle lives in NJ. Is it possible for my dad to give the shotgun to my uncle. Also how would he go about doing this?

    Since it is an interstate transfer, the transfer must be through a FFL. Since it is a long gun, the transfer can take place at a FFL in any state.

    So, your dad must deliver the shotgun to a dealer and your uncle must fill out the federal 4473 form and have a background check performed. Your uncle will also have to comply with New Jersey law, like having a FID card.

    Sooo my uncle can come to a PA gun shop and just pick it up so long as he has his FID card? How about transporting to back to NJ?

    That's the tricky (and scary) part

    If he keeps it unloaded and in a secure wrapper and drives STRAIGHT home.
    That should satisfy state law in PA and NJ

    I'm always unsure about this though

    Yes. Make sure he has the FID as New Jersey law requires. Some PA gun dealers may not want to perform the task, so they may have to shop around until they find a FFL that will do it and who knows the law.

    Even though there isn't a written exemption under NJ law for transporting a gun from a "dealer", it is an assumed exemption(people who legally buy guns must be able to take them home). There is an exemption under NJ law for transporting to/from a "gun smith", which to be a gun smith a person must be a licensed dealer. Also, possession of the FID card will also serve has a permit of sorts for justification.

    There wont be a problem under PA law.

    In addition to the FID card (the address on the card needs to match the one on his ID), your uncle needs to provide the FFL with the "N.J. certificate of Eligibility"

    With the NJFPID card, transport and possession of unloaded longarms anywhere in NJ is not prohibited provided the longarms themselves are NJ legal (e.g. no unlicensed assault weapons). There is no requirement to be coming from or going to any particular location. (ref NJS 2C:39-5c)

    Of course the NJFPID card does not privilege one to possess firearms in off-limit locations (ex: schools).
