psp gun registration/ sales registration question
My question is, what if you carry a gun you legally purchased from another state, that clearly wouldn't turn up in the sales database if the police runs your serial number
What happens then, does that mean if you plan on carrying a gun you purchased out of state that you have to carry your receipt with you to prove ownership?
Can they arrest you on the suspicion that the gun was stolen if it doesn't come up?

Hell no!
Police can arrest you for whatever they want..
I think the worst they would probably do though (if you ran into a really douchy cop anyways) is hold onto the gun until you can prove 'ownership' < and if they did that then I would ask for a receipt and pursue legal options asap.
Just my .02 cents..

They probably won't arrest you, but there's a good chance that they will seize your gun until you can prove ownership of it.

Re: psp gun registration/ sales registration question
You won’t be arrested unless the firearm is really stolen, or if it was reported stolen even then you might not unless you are or they can prove a criminal action on your part.
As computer records (non database) could be incorrect information with a transposed serial number even IF it was bought in PA by you, the burden still falls on you.
Nothing would prohibiting the police from (stealing) confiscating your firearm if it was run though a clean check (no crime committed) at point of contact with police running serial # and comes up with “no record found”.
You have the same problem IF you inherited / gift of a firearm or purchased a pistol through private sales in PA prior to June 1995 with the great expansion to the UFA (like FTF is still legal in more gun friendly states than PA) made this illegal.
You have the same problem IF you are a machinist and legally made your own private handgun from hunks of metal from scratch it never entered interstate commerce and didn’t require a serial number .
people got war trophy bring me backs that there is no record of entering the country or sales in PA
Plus a century plus of serviceable and useable firearms that were sold prior to all the focus on controlling firearms, they used to control criminals back then.
Plus several other valid reasons besides just outside PA sales that a firearm would be guns not included in any database or firearm register.
Even the Feds with the number of fixed transferable MG since the 1986 can’t keep or verify the accuracy of the NFA registered firearms with 100%.
All of these ex post facto (retroactive) laws is just another part of gun control hidden cost with firearm registry is just a shell game created to control US
Here is a story for you to read of what you may face at point of contact with police.
Gun stolen by Hawley PD.

jsoc was the poster that had a gun stolen by police at traffic stop and spent much treasure beyond what the price of the pistol was worth to get his firearm returned. All because it was legal bought and transferred in California, but was not in the PSP (incomplete) firearm registry of firearms sold in PA (ROS).
When PA does finally has a law requiring you to registry ALL of you firearms without exception (its not for lack of trying btw) these gun registration schemes still won’t work for its intended purpose for enactment to prevent criminal misuse of firearms for ill or evil purposes.Learn how to really SUPPORT the 2nd Amendment cause Go To http://www.foac-pac.org/

Re: psp gun registration/ sales registration question
So would it just be easier to carry your receipt if your gun was purchased out of state to prove ownership to the officer?

Re: psp gun registration/ sales registration question
PA statute states that you can not resist an arrest, even an illegal one (exception might be if a corrupt person was to execute you, maybe). My question is if you can resist an illegal seizure. I am guessing the courts would rule no, you can't. You must then follow with a criminal or civil action and not violence on the spot. On the other hand, taking property without legal justification is plain wrong.
We need to address this with a bill, perhaps? It is you. You have all the weapons that you need. Now fight. --Sucker Punch

Re: psp gun registration/ sales registration question
What would be easier is if the police followed the law and left people alone.
When they break the law and steal our property, they should be fired, fined and jailed. IMHO
If you think carrying a receipt is easier, make sure you carry one for your shirt, shoes and pants tooLast edited by BimmerJon; August 28th, 2012 at 03:19 PM.
