Form 1 SBR Caliber Question - Marking Requirements
Hello all,
I submitted a Form 1 several months ago. My form was kicked back for corrections because I listed multiple calibers in box 4c. I was told it is possible to list additional calibers and barrel lengths in box 4h instead.
My question is do markings for all of the calibers listed need to be present on the receiver at all times?
I had originally planned to use barrels with the caliber stamped on it instead of having all of the calibers engraved on the receiver. In that case, only markings for one of the calibers would be present on the firearm at any given time. My initial thoughts were that this would still be ok, since obviously only one barrel length would be present on the firearm at any given time.
Thoughts?I am not a lawyer.

Congratulations - your form being kicked back to you means that you're at the top of the list. After you correct it, it goes from the research assistant to the examiner.
List only one caliber only in the caliber field. Corrections can be made by a single line-thru with your initials and date next to the line-thru.
You can temporarily change calibers later but you must be able to convert the SBR back into its original configuration (configuration as submitted on Form 1). You do not need to list any other caliber or additional barrel length in 4H. 4H would be other descriptions/markings on the firearm.

Thanks for your response. Yes, I am looking forward to it.
I realize that listing other calibers was (and is) not necessary, however I guess my question was really if someone did list multiple calibers/barrel lengths in box 4h, would they all need to be marked on the receiver to satisfy the marking requirements, or would it be ok to have only the caliber "in use" marked on the barrel at any given time?
I ask because, in all of my excitement, I made a correction by adding the additional calibers to box 4h before remembering that I could have simply left only one caliber in box 4c and just made "temporary" caliber changes at will without listing them.I am not a lawyer.

I wouldn't bother putting anything else in Section 4H regarding different calibers or barrel lengths b/c it is not necessary. You are able to swap calibers/barrel lengths/complete uppers as long as it is a temporary change. I know you're just trying to cover your bases but I think you're making it harder than it needs to be.
Just use a line-thru for the corrections you made in 4H.

I would, except the form was already sent back. I know, it was dumb.
I'll know better for next time, but for now, my question stands: is the SBR required to bear makings for ALL calibers listed in box 4h at the same time, or only the one "in use" at any given time?I am not a lawyer.

I recently had a Glock auto sear kicked back for similar paperwork issues.
Marking requirements differ from form (registration) requirements.
The only markings REQUIRED by law to be on a NFA weapon is Manufacturer Name, Manufacturer City, Manufacturer State, Serial Number.
That is it.
Now for forms, you will also need a Model Number. That is required.
For a full gun they are going to want to see a caliber, barrel length, overall length, etc. Everything that is 'applicable'.
This is straight from Nickie Dudash (the PA NFA Branch Examiner) and several NFA Specialists.
I'd send a letter in just to be safe. You can also call in to the NFA Branch and ask to speak with a 'specialist', however as said you'll likely still get a few different answers.Last edited by cds_arms; August 27th, 2012 at 04:12 PM.
