    Default ar-15 pistol build

    was looking for a recent thread and could not find one , bought a new stripped lower today,I was asked if I was going to build it into a rifle or pistol. I always thought you could build it any way you wanted short of s.b.r. or machine-gun he said it would change my paper work on how I was going to build it . any insight would be helpful thanks.

    Stripped lower should always be registered as a "receiver". It does not become a pistol until you configure it as a pistol. It does not become a "rifle" until you configure it as such.

    If you register it as a "rifle" it can never become a "pistol" but a registered "pistol" can become a "rifle" or "SBR".

    Actually, the state paperwork does NOT trump the Federal (NFA) definitions. You can buy that receiver and treat it as a pistol receiver or a rifle receiver at the time of sale, but it doesn't become a "rifle" for Federal purposes until it's barreled. (This assumes that you're building for personal use.)

    It used to be that ATF considered it "once a rifle, always a rifle", so that after you assembled it as a rifle you could never go back to a pistol without filing a Form 1 and registering it as an NFA SBR. But they recently relented on that, and if it "started" as a pistol, it can become a rifle and then go back to a pistol. But if it started as a rifle, then it can never become a Title 1 pistol.

    The paperwork shouldn't refer to a stripped receiver as having any barrel length, because that would be untrue. If it's just a receiver, do whatever paperwork makes the FFL happy, you don't foreclose your future assembly options until a barrel and perhaps a buttstock is attached (or grouped with the receiver and associated sufficiently for it to be constructive possession).

    so I can build it into a pistol with it transferred to me as a receiver ? did not fill out paper work to have it registered as a pistol.

    Had the same FFL transfer a stripped receiver w/o the SP4-113 paper, then filled out the SP4-113 paper for my next stripped receiver transfer. They told me they made a mistake on the first transfer, and if I assembled a pistol with that stripped receiver, without 'registering' it first, I would be committing a felony.

    I know, I need to stop posting and get a lawyer.

    Well, my other receiver has a 16'' upper on it.

    thats a little confusing , so I can build a pistol and not be breaking any laws ,if not I will pick up another one and fill out the paper work for a pistol

    Probably meant to be that way as the PSP thinks the average gun owner doesn't know state laws, and the PSP can confiscate their handguns when the serial # of said gun doesn't show up being registered. JMO. IANAL!
